A hypothetical scenario

A job is advertised internally with a number of essential required ‘skills’.

The skills are the only measure to pass any HR sifting process, although by no means what is required to do the job in terms of knowledge and experience.

The job is fairly technical, and combined with the skills required, there are probably not going to be many applicants meeting the requirements.

There were no applicants.

Approach the recruiter, and clearly told (in writing by email) that the essential skills are not a prerequisite to do the job.

Job is re-advertised.

A formal application for position made.

Job closes and HR say that the application won’t be taken forward because the applicant doesn’t have the essential skills required.

It then comes to light there has also been another applicant who does have the so-called required skills, so while one applicant will be allowed an interview the other will not. However, it is not clear who this other applicant is, or if they even exist.

(It further comes to light that the recruiter had actually approached HR about allowing others to apply beyond the skills listed, but was told no)

In reality, this is a direct attempt (by HR) to prevent one applicant getting the job, but we have to play along with the skills arguments.

Advice please.

    As long as it’s not because of a protected characteristic this is perfectly legal.

    They can appoint anyone they like to any role they like; and conversely not appoint anyone they like

    That's a very specific set of circumstances for a hypothetical situation.

    So the answer is that the employer can recruit in any way they wish provided they do not break the law. There is nothing here to suggest they are breaking the law.

    What about if you were basically treated as free labour and we’re floating jobless.

    That is with no permanent job, just doing work for random teams.

    As such you only have a limited time to get another job before they try and push you out, consultation etc. Although if you have some temporary work maybe you have a bit longer.

    But of course unable to get another job because every job you apply for you are told you won’t be interviewed for.

    This is a consensual business arrangement between adults; no one is holding your hand; nor are they holding a gun to your head.

    When the job was readvertised somebody with the required skillset was found so I don't see the issue. If one applicant without the skillset had been allowed to apply but another hadn't I can understand annoyance but there is still nothing that can be done about it.

    Contact the Ministry of Fairness. They’ll send in a team who’ll seize and examine the records related to the recruitment exercise and interview those involved. If sufficient evidence of unfairness is discovered you’ll get an apology, a permanent contract with backdated benefits, a ‘Let’s Make it Fair!’ tshirt and mug, and those guilty of unfairness will be sent on a Fairness Awareness course.

    Seeing as this is a purely hypothetical thread I see no reason we can't have purely hypothetical answers either so I'll go along with this.

    Please note, however, that under new regulations you'll only be able to appeal to the Ministry of Fairness if you've been in continuous employment for over ten years, and can supply an affidavit from your great-grandmother testifying to this fact. You'll also have to deposit a small bond of £45000 towards the cost of the appeal process, which will be refunded to you if your appeal is upheld. You'll also be responsible for your own travel arrangements and expenses to the Ministry of Fairness Assessment Centres, which are conveniently located at Foula (for claimants in the south of the UK) or Bryher (for claimants in the north of the UK). Assessment Centres are operated on behalf of the Ministry of Fairness by Suck It Up Consulting Ltd. All Suck It Up assessors have completed training in school of hard knocks therapies and making the best of it life coaching.
