Help needed with contract

Good evening all. Please could I ask for advise on the predicament I find myself in.

I currently work for a small business in the capacity of a self employed sub-contractor and I am looking at leaving for a position elsewhere.

In my contract it mentions I have to give four weeks notice. Is this correct and about right?

Whilst working at this company I have attended a couple of courses and they now say I have to pay them back these costs. There is no mention of this in the contract. Is this enforceable?

Any help would be greatly appreciated.

If you agreed in a contract to give four weeks notice, then this is what you need to give.

If you signed or agreed to anything committing you to repay the cost the courses then you will need to repay them. E.g If the company sent you an email saying if we send you on the course and you stop working for us within x months you will have to repay some/all of the cost of the course, and you didn't dispute this but did go on the course, you will need to pay this. (You can agree to something if you proceed as though you were in agreement)

If there was an offer of training and a stated need to repay it but no time period was specified, then you can make an offer of how much you will repay. The company can take you to court but are unlikely to win anything more than a fair offer.
The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.

What kind of company pays for the training of a self employed contractor? What kind of contact do you think you have?
  • Hi thank you for your reply. No mention of paying anything back from the company in any email I’ve received.

Bear in mind that your employer might try to reclaim the training costs from your final payment, regardless of whether they have an entitlement to do so. Ensure you have sufficient savings to cover this eventuality as it would take some time to reclaim it through the Small Claims Court.

You could upload it to a picture sharing site and then post a link. As a new user you can't post links so you could substitute xxx for www and we can then pick it up.

Make sure you obscure any identifying information first!

If you are truly self-employed, you can send someone in your place for the 4 weeks notice.

The reimbursement of cost by either party will be down to the wording of the contract between the companies involved.
