Parking Fines Limited Company Nightmare

Hello,

We are a small limited construction company, we conducted a job in London in 2017 from jan to around July.

There was a major problem with the parking system and as a result we were issued 32 parking tickets.

It’s a long story but basically there system is one which you do not it but sign in on a register and this prevents you getting a fine.

After 9 months of letters and going back and fourth of 29 tickets were dropped and 3 still upheald.

We went to court and the judge found us innocent on all 3 cases.

We believed this would be the end of it however we have just received another summons for another ticket which we have photo evidence on the actual day to again prove our innocence.

We intend to again go back to court and defend again based on the same facts as the last 3.

Do we have any grounds to start a counterclaim? We have spend many man hours defending these claims and to be honest we have had enough.

    if its private, name the PPC and any solicitors acting on their behalf

    Flipping heck, it sounds to me like ''yes you do'' and I would.

    They have caused you actual losses of man hours (albeit I don't think a Ltd company can be 'harassed' so I don't think you can claim under the PFHA). But, I reckon you should do a counter claim for excessive and unwarranted misuse of the registered keeper data, like Henry Hippo on pepipoo did in the first case he won in the Spring. Under the DPA.

    Have a look for his thread with the counter claim that won, on pepipoo forum (beware he had two cases, it's the earlier one I am thinking of). Pretty sure I have reproduced his counter claim words on this forum in the past few months, as I wrote it for him.

    Edna Basher (a regular poster here - Dennis Basher on pepipoo) takes an interest in company PCNs, and might like to assist on this thread too.

    Has the company filed the AOS online to acknowledge the claim?

    A counter claim needs compelling wording and evidence. If you need more help than we can give, we do sometimes recommend this firm:

    Thank you for the reply, we have recently moved address and the summons was sent to the old address - the ticket is for a vehicle we sold 6 months ago.

    As a result the letter was issued on the 13th of August and we have only just been handed it by the new tenant.

    We have just filed our AOS - is this going to cause a problem?

    It sure how we could have got it any earlier a little bit out of our control!

    bear in mind that this is a civil claim, so its not a "summons", its an MCOL

    does the online system tell you when the defence should be submitted ?

    if not, double check by ringing the CCBC tomorrow

    Might well do. You might have a CCJ to set aside, first.

  • Sorry I’m not great with the terminology REDX I’m not a solicitor.

    The previous cases were all dealt with before we moved so I doubt they would have had the new one.

    Did you notify Companies House of your change of address before the 13th August?
