Mortgage and Ex... Help!!

Hi there, any advice here would be much appreciated.

My mum is currently living alone with her son following divorce from his dad 8 years ago, in the family home.

This house was bought off the council for a reduced figure 10 years ago with the mortgage taken out it both her's and her ex-husband's names. Since he left, mum has been paying the mortgage 100% by herself although the mortgage is still in both names.

He has since re-married. The problem is getting his name off the mortgage and therefore securing her own and her children's future. Both herself and her ex want to sort this out. He also wants his name off the mortgage for a reasonable lump sum which mum is happy to pay him.

My question is, the solicitor's fees have been mounting up which mum is struggling to afford (solicitor now wants another £1k to carry on the case) so they want to sort it out legally out of the solicitors hands and not line the legal beagle pockets! Can a legally binding financial agreement be met without solicitors? They are thinking along the lines of making an appointment with the building society the mortgage is with and getting them to witness a clean break agreement. The building society have already accepted mum can pay the mortgage by herself. My mum's ex has drawn up a clean break order. Can they just get witnesses (professional or otherwise) to countersign this?
