Seeking legal advice if you are unsure of the legalities of what your employer doing is a very sensible step to take.

In fact I would strongly encourage more posters on MSE to seek qualified legal advice as opposed to listening to some of the advice posted on here!

If your depression has been creeping up on you for some time, with a lack of motivation, it could well have been reducing your performance. In that case, following your doctors advice could be presented to work as part of your actions to improve performance.
