Job Offer - Pre-employment checks and CCJ, "Fit & Proper" & "Financial Integrity"

I have received a job offer from a Big 4 Accountancy. The role is, however, an Advisory role in an aligned business with no Financial Services clients. Think more Food, Consumer Goods, etc.

I have been set a series of Pre-Employment checks including Address History, Work History and a Financial Propriety check.. "Have you ever failed to satisfy creditors in full?" and "Declare any CCJs/IVAs/Bankruptcies, etc".

I received a CCJ from a Lettings Agency/Landlord at my old student address in Jan 2015. I had dropped out of the University in 2012-13, given notice on the property and left within a month. However, two years later the Lettings Agency initiated a CCJ against me to my home address.. I missed the paperwork as it was sent to my home address and not to my new student home in another city.

The Agency entered receivership 2 weeks later (Jan 2015) and the parent company was liquidated not long after. I have therefore been unable to make arrangements to pay. The value was around £3100.

What can I do to ensure my offer of employment remains? Do you think I have a chance of working at the establishment or will I be dismissed out of hand because of a student CCJ?

Any help would be much appreciated!!

Hi bsr90 and welcome to MSE,

If either the letting agency or their parent company were a limited company, you can enter their details on Companies House - https://www.gov.uk/get-information-about-a-company and it should tell you who the liquidator/ insolvency practitioner is.

Once you know that you could arrange to pay them in full, directly, and get the CCJ marked as settled. Or, if you cannot afford this you would need to apply to the court to vary the judgement to pay it gradually. Unfortunately, the money is still owed, and the liquidators could take enforcement action. If you need to vary the CCJ you will need an N245 form, which can cost up to £50 to submit (you may get this waivered if you are on a low income or certain benefits). You will need a SOA and can make an offer to pay. If that is successful, and you maintain the payments, they would not be able to take any further action.

However, whether this will be enough for the employer to keep the job offer open, I cannot say. The CCJ will still show on your credit file for 6 years from the date of judgement. You would need to check if you had a CCJ but the payments were up to date/ settled, would that be acceptable?

Morning mate, I work in HR in a similar organisation that is regulated by the FCA. Just to set your expectations, its highly unlikely you will get offered the position if the CCJ is on your file. Even though you say you have no FS clients, and its an aligned business its likely they will follow the same guidelines as the BIG4.
