Can Lowell request my passport?

There has been an ongoing case with this company, citizen advise is helping as well as the account they claim i opened with phone company in 2014 has been opened by someone else as a fraud... I do not remember having account with them, they ask me to pay £ 750...In 2014, when the account was opened, i lived in a share house with other 6 residents.. There is CCJ against me in England however i live in Scotland for over 2 years now... There is wrong date of birth and they now request my passport and proof of my addresses for April 2014-i have none....any ideas?

    I'm not sure what they think a passport is going to produce.

    If CAB are helping you, I'd be guided by them until they give up. It's important to have one strategy and stick to it.

    I imagine they'll be looking at a setaside application

    Do you not have any bills or correspondence from 2014 with your address on? If not, would your ex-landlord be prepared to write a letter confirming your tenancy dates? Bit of a long shot, but worth a try.
    Passport: as I'm guessing you are not a UK national, they presumably want this as proof of your date of birth?

  • i think they are asking for the passport because i told them they have wrong date of birth of the person who opened the account in my name....not feeling it is secure to send it to them
  • i really do not have anything from 2014...they ask me for utility bills, or contract...it was a share house where i only signed contract and never got a copy of it, i only lived there for 3 months...who would think i will need it nearly 5 years later. :-(
  • In addition there is a CCJ against me, but i never got any letter because i changed my address... so i even didn't have a chance to go to court to defense myself in this case, now i live in Scotland and they threaten me with executor, but they need to go through Scottish court first - citizen advise lawyer told me they cannot use English law in Scotland

    Unfortunately the CCJ will be valid, because it was sent to your last known address, which is all that is required. It's up to you to advise your creditors of a change of address if you move. You can apply to have it set aside if you contest it, but not on that basis.
    It's correct that the County Court has no jurisdiction in Scotland, but they can of course take action against you in Scotland if they wish.
