Dispute over final pay.

Hi everyone I recently left my job after 15 years I did it all correctly handing in my notice as stated I was to give a month and I did so. However my final pay was 2 weeks short of what I was expecting. When I questioned this with my very unreasonable employer she replied that's because your paid 2 weeks in advance and 2 weeks in arrears. I said it was the first I'd heard of it as my contract states paid monthly in arrears. She said it's always been 2 weeks in advance and 2 weeks in arrears. I then asked her surly even if this was true she would only be able to take back 2 weeks pay of what I was earning 15 years ago as opposed to my current wage which is substantially different. She's being very unreasonable and not backing down I feel I need to take this further but want your opinions on where you feel I stand with this? Thanks in advance.

    What date did you give notice?

    What was your normal monthly pay day?

    And although you didn't ask about this, and that's not what your employer was saying, had you taken more leave than you were entitled to? To answer that, when did your leave year start, how much leave were you entitled to (statutory minimum is 28 days but pro rata in your first and last years), and how much leave had you taken?

    You need to establish the pay period and the pay day for that period.

    if done properly it will be the current pay if you left during a pay period.

    Do you have all your pay records.

    holiday should identified separately.
  • My notice was handed in June 12 and July 13 was my final day. Pay days were the 15th of each month and they paid me 10 days of holiday I was owed because I had only taken 1 day prior to leaving. Then I was paid 9 days on top of holiday and they withheld 10 days because they said that was paid in advance when I started despite there contract stating paid monthly in arrears. Thanks

    Ask them to supply you with written evidence, if you have a written contract of employment from when you started stating what you say i cant see they got a leg to stand on

    Well that could be about right ...

    If you started on 1st June, let's say, but were paid a full month's wages on 15th June, then you wouldn't be paid for a full month if you left mid-month.

    This is why getmore is asking about the Pay Period.

    Where I work, we are paid on or before 25th of each month (the pay day). But the pay period is the full calendar month. So if someone gives notice to leave on 25th, they will have days deducted because they're not working a full month.

    If someone starts on the 5th, in their first month they'll have days deducted for not working a full month, but they'll be paid up to the end of the month. In subsequent months, they'll always be paid for a full calendar month (until they leave).

    You keep saying she's unreasonable, but could it be that you are? If you are paid monthly, it is highly likely that your payday is the middle of the month - hence her comment that it is 2 weeks in arrears and 2 weeks in advance. Pretty generous - most people don't get paid until very close to the end of a month.
  • Yes I say she's unreasonable because she refuses to show me any form of evidence and when I mention the contract states different to what she's saying all I get is they were written up years ago things change although she also says it's always been the case. I started at this company I was not paid on the 15th I was paid every 4 weekS so the actual pay date changed from month to month. My pay period is now 15th to 15th.
