    If you are no longer in an apprenticeship, (and apprenticeship must include studying towards a qualification to qualify as an apprenticeship for the purposes of the minimum wage laws) you MUST be paid at least the national minimum wage so if they're paying you below that by claiming you're an apprentice whilst you're no longer studying towards a job related CGLI etc they're breaking the law.

    Even though there is no written contract of employment a contract does exist and is governed by statutory employment law so you have for example 5.6 weeks paid leave, your employer has to enrol you in a workplace pension scheme, you have limits on the hours you can work and minimum amounts of daily and weekly rest and the right to breaks during the working day.
