Not paid holiday pay!!

Hi there,

I left my job four weeks ago and worked the notice my boss asked me to when I told her I wanted to leave.

Up until then I was paid every four weeks and we just got paid commission on our takings (hairdressing) then our holiday pay was worked out by taking a daily average from the previous four week period and we were paid that as a day rate times by the amount of holiday days taken.

I returned from my holiday, worked a week then worked the final week notice that was asked of me.

Four weeks on and I got paid for that four week period (as it’s paid four weeks later) and I have not been paid the holiday pay, just the commission for the 2 weeks I was there before and after my holiday.

My old boss is not a very approachable person so I wanted to get a second opinion on if this is right or if I am entitled to that holiday pay, before I query it with her.

    You are entitled to holiday pay for every day you've worked.

    However, I can't quite follow what you say.

    Your statutory entitlement is 28 days if you work a five day week (or more), but it's always pro rata to how much of the holiday year you have worked.

    So have you taken more holiday than you were entitled to?

    Your post is quite confusing. The owner may be difficult to approach, but asking her to clarify is likely to be the best way to get the matter resolved.

    - What is your annual holiday entitlement ?
    - When does the holiday year run from?
    - How much (total) holiday have you taken in the current year?

    You are entitled to be paid for any holiday time you have accrued. Statutory holiday entitlement (if you work full time) is 28 days per year, so you build it up at the rate of 2.3 days per month. If your holiday yest started on 1st January, then as at 20th July when you left you would have built up about 15.5 days entitlement. If you have had less than 15.5 days off sine January (including any bank holidays) then you would be entitled to be paid for the difference. If you have had more than that then your employer would be entitled to deduct the difference from your final pay or to treat the most recent time off )or part of it, depending on the appropriate number of days) as unpaid. If your holiday year starts other than on 1st Jan or if your entitlement is more than the statutory minimum you would need to work out the figures based on your personal situation.
