CCJ threat

Hello.I hope this is the right thread.
I have a debt from an old employer, they started CCJ proceedings but we came to an agreement that I would pay the debt off over 2 years and they would stop CCJ proceedings. However the debt company that was trying to get the money back has added over £1000 worth of “costs”
I have been arguing that I will pay back the original debt but not the costs.
If I stop paying the agreed monthly instalments when the original debt is paid could they take out a CCJ for the “costs” they claim are now owed?

    Debt collectors do not add interest or charges unless the original agreement allows them too.

    Who or what is this debt company ?

    Who owns the debt ?

    Was it just a threat of court action, as once a claim is started, it cannot just be stopped.

  • I agreed it with my employer
  • The company who tried to collect the debt is TNC Group. They are saying they are court charges for starting the CCJ process etc.

    My employer used TNC to track me down and they raised the CCJ.
  • The additional "costs" they want are £1196.35 and this covers the collection agency costs and pursuing the CCJ.

    So you have a county court judgement then ?

    They cannot charge you court costs if it has not been to court, unless you have voluntarily agreed to pay them.

    No I dont have a CCJ, nothing is on my file. I offered to make monthly payments so it didnt have to go to court. They had started the CCJ process as I received the notification in the post and had to log onto the court site to submit my plea and fill in an outgoing sheet. This is when I contacted them offering to pay in instalments.

    This is from their email to me
    The original debt to us upon leaving was £2738.91. We chased this for considerable time before taking this via the legal route and unfortunately due to the CCJ that we obtained there were extra costs. The extra costs came to the figure below of £1196.35. This was added to your bill. The original 24 months at £114 would cover the original debt, however the extra charges would mean this would continue for another 12 months at least.

    We then held the CCJ at your request as you did not want this to impact on your working life as you stated you worked in the financial sector. If the payments do not continue then we will simply apply for this to be re-instated.[/FONT]

    So they have obtained a CCJ, they just have not enforced it as yet.

    That is what this means.

  • I agreed to pay the original debt. All my emails have stated that i will not pay the costs. I have emailed them multiple times asking for a breakdown of the costs and they have not supplied them.

    Why have i automatically agreed to pay the cost? I haven't signed anything
