Re-mortgaging/removing a person/interim charge attached

Hi All
Can anybody help !!!128591;!!!128591;!!!128591; My girlfriend is divorced but currently owns her house with her ex.We have got a mortgage sorted but an interim charge is attached to the property in her ex's name.This stops us removing him and adding me to the land registry for the mortgage to progress.How do we go about removing this charge against the property?..we have extra money on the mortage to pay off the joint debt but cant release the funds to pay it until its removed.

Have you not spoke to him about him removing / revoking the charge? Is he being bought out? I would assume he is after a financial exchange to remove his interests against the property.I am a Mortgage Broker.

Hi YHM...Yes he is being bought out by ourselves.I am just confused with how he is going to remove or postpone the charge.Will his loan company require the amount to be payed off in full before removing? Or do they usually allow you to come to an agreement and postpone it to let the loan to be repayed?0

If you are paying off the charge, it should be done simultaneously with the new mortgage.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. When I was in a similar position I paid the charge off with a credit card. I could just see things going wrong with the charge still there, especially with our seemingly incompetent solicitor involved.0
