Debts and CHB

Can i put this idea across and see what people think.

OH going bankcrupt which leaves me with debts of approx £5.5k, the only income i have is CHB(child benefit) in my name which would cover the minimum payments on my debts except for a joint overdraft which i would have to come to an arrangement with them to pay it off once OH is bankrupt and they start chasing me, could i continue servicing my debts and on OH bankruptcy form say that my contribution is £ (CHB - my debts servicing), or is that looked upon as OH servicing my debts cos CHB is included his expenditure sheet? i really don't want to go bankrupt for such a small amount or is that the only choice?

I'm so confused and terrified about creditors chasing me.

Any advice greatly received

    Did you say on another thread that you were using cccs?

    These guys should be able to explore your options with you.

  • I thought Child Benefit was exactly what it says it is, benefit for a child?

    Even though child benefit is taken into consideration as your income, the whole amount could not be used on paying debts surely?? that's just wrong!

    We have been dealing with CCCS in relation to OH debts and hence going down the bankruptcy route but i am totally confused about where that leaves me and my debts - they have sent me letters(joint names and expenditure sheet) and advised me to send a letter off to creditors but i have read on here that many creditors just ignore letters and my debt is going to get bigger each month if they add on late fees etc.

    I know over time if i was to use CHB/CTC i am receiving i could clear the debts and save a lot of hassle with creditors phoning/sending letters which i find very stressful, although i'm not declaring myself B/C i have still opened a cash account to keep me in control and OH will be opening his own after B/C, was just wondering if using CHB would be frowned upon in respect of OH bancruptcy?

    I think perhaps i need to call CCCS again but put my situation across rather than OH or jointly which is what i did before.

    I agree, guess i'm just desperately looking for a way to pay my creditors because i am absolutely terrified of not paying them. I would rather go without the basics for a while longer and keep paying but as OH has had no choice but to go BC its put me in a situation, i want to return to work in a year or so and if i can just tick along until then.

    Too much thinking tonite i think, i will call CCCS tomorrow and state my situation and see what advice they give

    Contacting CCCS again would be a great idea. As I said in another post all but one of my creditors ignored the letters I wrote to them but you should still write to them and when they phone tell them you are speaking to CCCS to help you with your debt (no need to tell them about your husband and BR). CCCS should be able to contact them on your behalf to offer reduced payments.

    Just a small observation. you say you are only getting child benefit. can you not claim anything like dole money etc to help you out a bit? I'm not saying to service debts, just to help you out financially that's all
