If a court awarded a compensation claim against a driver which the insurers declined to pay out, would that claim be included in a future BR, the individual has no savings, no assets and only debts.

This would be a bankruptcy debt if it related to non fraudulent ordinary damages.
If there was any claim for personal injury, this would not be covered by bankruptcy.
