Hi, my DRO was accepted about a month ago and im on the insolvency register.
All my creditors have been informed and 2 of them have written to me to say they will now not ask for any payments, however the others are still sending threatening letters demanding payment, not aknowledging the DRO at all. What should i do?

Hi,
Sometimes this happens due to a lack of communication.
Rest assured, they cannot take you to court, a DRO gives you complete protection from that, so its not a worry anymore, more of an annoyance really.
Look on the lighter side, have a good read of those letters, see how ridiculous they really are, the thinly veiled threats are really laughable.
Have a little fun with them, and get some compensation at the same time.
Send in written complaints, give them your DRO number, screenshot of your inclusion on the insolvency register, ask for £50 compensation for the distress caused.

I had this with a couple of my creditors. Luckily, most of them just adjusted it as soon as I pointed out, but Santander gave me a lot of grief. I ended up getting £50 compensation ... then they carried on harassing me. In the end I emailed the CEO of Santander UK direct and ended up with another £50 compensation and they got it sorted for me. Good luck.0

Hi Gellerbing,
Are you able to clarify which debts are not acknowledging the DRO please? Hopefully this is simply a communication issue as stated above, and can be resolved with a complaint; however, some debts are excluded from a DRO. Things like, magistrate court fines, child maintenance arrears, student loans, fraudulent debts, TV Licence arrears and social fund loans are all excluded, so if you are being chased for any of these, they will still need to be dealt with.

That's almost a complete list of excluded debts. However, because a debt may be fraudulent does not mean it is excluded. It would contribute towards the 20k limit and would not be allowed to collect during the moratorium period. It's just that the debt would not be written off at the end.0
