    On the other hand, if it not the same fault then that indicates that the car has a series of issues with it, which is making it basically not fit for purpose. But until the fault reoccurs (or a new fault occurs) then they can argue that they have fulfilled their duty to offer repairs as appropriate.
    (Although I could be wrong, I often am.)

    Fwor - I have just had Ford print off the work history of what they have done and every time it’s says warentee work customer still experiencing intermittent cutting out that must link the problems surely

    You will need a report about the existing fault, not a record of faults that it had in the past.
