Letter from PCO HOLDCO SARL'S Agent

I went into an IVA in October 2010, finally I was out of it in June, 2017 after 7 years of dragging it with my then Debt Free Direct. Instead of them declaring that I have completed it they terminated it after good 7 years, simply because they were going burst. I was the one that informed the public register because Debt Free Direct did not inform them, after 3 months my name was removed from the public register. The problem now is a letter is coming from a solicitor's firm claiming to be acting on behalf of one P C O Holdco S A R L. Please kindly advise. The IVA status has been removed from my credit file after it was taken off from the public register.
All the debts with all my creditors then have all been removed from my credit file.
Please advise.

  • The letter says they are acting on behalf of PCO HOLDCO SARL, that I should contact them regarding my debt and they are ready to agree on payment terms with me. I just ignored them because I don't know them and I am not indebted to them.
    But I remember long ago when I was in an IVA I got a letter from them saying that they are my creditor now regarding my credit card debt with Lioyds tsb which was part of the IVA.

    Are you thinking of going bankrupt?

    If not, and you're just dealing with non-priority debts coming back to you after a failed IVA, then the debt free wannabe forum might be better.

    The first thing we need to do is clarify the situation with your IVA. If it did not complete it means the balance of your debts will not have been written off. However an IVA company going out of business is not grounds for an IVA to fail. A new company should have taken over, allowing you to continue with your payments and for the IVA to complete.


    Can you remember the exact situation of what happened? Was there any mention of you breaching the terms of the IVA?


    If the IVA did not complete you will still owe the remaining balance of your debts (regardless of whether the IVA and debts have been removed from your credit file), which will explain why a company is now contacting you about setting up a payment plan. You may find that other creditors will start to do the same.


    I'd recommend you get in touch with one of the free debt advice agencies to explore all your options to deal with these. As fatbelly mentions, you can also post on the Debt Free Wannabe board for more responses.
