Hi. I'm after some advice about eBay collections. I sold some records on eBay and sent them to the buyer. They then said they were not as described and sent them back, but I've never recieved them. They had proof of posting. I contacted ebay and they phoned me a couple of times trying to help but the calls have stopped and I'm getting emails saying the " debt " could be passed on to bailiffs. I only sold them as I was desperate for cash and now I don't have the records and am being chased for the cash. I'm currently bankrupt as well. Sorry for the long winded post but does anyone have any advice on how I can proceed with this and what is likely to happen if bailiffs get involved ? Oh and the so called debt is £190. Thank you.

Who mentioned bayliffs to you ?
Do some research please, bayliffs can only be employed after a debt has been to court, you have had a CCJ awarded against you, and you have defaulted on the court payments.
I assume they mean debt collectors, totally different kettle of fish, DCAs have no power, especially where eBay debts are concerned, they just send a few letters, and growl a lot, they will soon get tired and go bother someone else, very unlikely to go to court.
If you are currently bankrupt surely you must know the drill where debt and debt collectors are concerned ?
As regards the records, if the buyer has proof of posting, then you should contact Royal Mail, was it a tracked service ? What was the date of your bankruptcy? And the date of the ebay transaction?
Just wondering if it would be a debt in the bankruptcy.0 -
If it was not as described you would have sent them a postage label via a tracked means? in which case proof of delivery is required not proof of postage. If the buyer didnt send them back via a tracked method, and they do not have proof of delivery, they do not have a leg to stand on. did they open a case? what status is the case at now? you need to talk to ebay - do it by phone or online chatYou're not your * could have not of * Debt not dept *0

Thanks sourcrates. Sorry I did mean debt collectors. I've just never been threatened with them before so wasn't quite sure what would happen. Thanks for the info and help.0

They did provide tracking and have a signature but obviously not mine. Lady from eBay help did say they were having problems with parcel force confirming delivery to the right address. The last call I had off her was to say I needed to provide proof that I hadn't had them ??? How I have no idea. Since then it's just been emails.0
