Found out my job is being advertised as a vacancy

I have recently found out my job is being advertised as a vacancy and I had no idea I was supposedly being replaced. I have not been told anything by my employer but I have reason to believe they are looking at possibly sacking me. I have no idea what possible reason they may have, but my question is, can employers advertise for your position without initiating a disciplinary process first? I have been there over 3 years and as far as I know I have not committed anything deemed as a sackable offense.

If it really is your job, then advertising it while you are still in post suggests that any disciplinary process would be a farce as the outcome has been predetermined - which is automatically an unfair dismissal because the employer has not followed their own disciplinary process and you've been there for more than 2 years.

However, your comment about 'reason to believe...' suggests you know full well there are issues, possibly ones meriting summary dismissal?? Even so, it's a foolish thing for an employer to do, because it still almost certainly falls foul of what would constitute unfair dismissal.

Talk to your employer and fine out what's going on before you panic. Weirder mistakes have happened, so don't burn any bridges until you know what they have to say.

You can't just be sacked after three years employment without going through any performance management process.

Are you sure they are not just expanding your team?

I would take a copy of this advert as you can use it in any wrongful dismissal legal case if they do just sack you

I say reason to believe, not because I may have done anything wrong, but just because the company has previous form, they done the very same thing to one of the management team recently ie advertised for their position before eventually getting rid of them. Also in a team of 6, I am the only person the new manager has asked to run through what I do, and they took notes of absolutely everything after which they had a two hour meeting with another management member discussing my duties (they told me as much). Not something to be concerned about on its own, but when there's a job advert as well...

Our team is definitely not expanding, another team member recently asked to be moved to a different department but was told the company didn't have the finances to recruit new staff to take over her position.

I have already taken a copy of the advert, it has the date on there which is the important part if they then decide to roll out a disciplinary process after the fact

Perhaps she has now got her wish - you are to be moved into her old post - they then need to fill your post ?

  • Where is it being advertised?

I ask as I received an unsuccessful email from Indeed around 4 months into a role as the successful candidate. Though it turned out the person above me was going through "mutual agreement".

The likes of Indeed are funny anyway - they confirmed it isn't always the employer going to them which is why you do sometimes see the job expiring dead on 24-48 hours later.
