Capital One (Problems)

:eek: I am currently having problems with Capital One - we have been in an agreed DMP with them and other for the last year and sent out a review recently offering a small increase to all creditors due to a payrise and no increase in expenditure. They have written back and asked for proof of income and a copy of at least a months bank statements so that they can check our income and expenditure and if it differs ask for any excess they feel they are due. We have written back with proof of income and told them that after seeking advice from a debit councellor that we are not obliged to send them the bank statements and so would not be doing so. They have responded basically saying that if we do not send them then they will not agree a payment plan or freeze interest. My problem is that some months like most people we spend a bit more on one thing and a bit less on another but basically it evens out over time. For instance i have recently had some leave from work so the petrol money was not as much that month etc etc. Capital One state that if the figures dont add up they will require a new SOA based on their figures. I was advised by payplan and my debt advisor that if we get any small amounts of overtime we can put them to one side for emergencies and that you overall allowance from your SOA once agreed doesnt really matter what its spent on as long as you dont go over it. SO what do i do? Do i tell them to take me to court? and keep making my current offer of payment until then? This is evidentally their new policy since August 07 and will apply to anyone on a DMP ie show them your personal bank statments or they wont agree a plan. Any advice please.

I had a similar request in September and sent them a copy of my pay slip and bank statements but not Mrs Leixlip1's as the debt isn't hers. Cap' One didn'y query anything (like you I've had some expenditure blips) and agreed another 6 months of no interest/charges by return of post.
I think all they were interested in were confirming payments to other creditors and making sure my income details were (more or less as it varies slightly each month)) accurate. Mrs Leixlip has a seperate bank account so they had no way of confirming her income but didn't bother to pusue.0
