Banned from home shopping

Hi and sorry if this is posted in the wrong thread.

I have been shopping with a major supermarket online due to disability. All I required was for the shopping to be put on a shelf in the kitchen to help manage then putting it away if I had to. A driver was pretty reluctant to help with this matter even though he knew I had problems. He wanted proof that I was disabled and to which he also noticed in the corner of his eye a set of walking sticks and within seeing them he would put the shopping in the kitchen.

One day a meal had been made which was quite aromatic with which on the same day had a delivery by this said driver. Upon his next visit he came to the door and advised me that he would be leaving the shopping at the door and not entering due to his last visit that the smell of food was overwhelming. With this I refused the delivery and also swore at him as well. Ok, I shouldn't of done but then this has now led me to being banned.

I have since tried to re-establish myself as a customer after a year but the manager is never available to deal with it.

It was only ever this one driver that seemed to have a problem with me and would get on very well with any other. Is there anything I can do? Have I shot myself in the foot due to my rudeness. As far as I am aware I was banned for life

    I think that the driver's behaviour was not only "out of order" but could well have been a breach of the Equality Act.



    Get some advice, then WRITE (old-fashioned letter) to the supermarket. Apologise, but make it clear that you swore only because you had been very upset by the driver's actions that were not only upsetting but also illegal.

    I think there will be certain criteria for which a driver may not enter a house; as to whether it ponging of dinner is one, I couldn't say.


    However, most companies take a dim view of abuse, so their refusal is understandable.


    I don't know if there's a statute of limitation for the ban, though.

    Care to explain how the driver's action could be a breach of the equality act? I don't know their rules but would think that for insurance purposes responsibility stops at the door
  • Depends on what was cooking too I would think! Some people can't stand strong smells such as Fish or Curry and would not be able to tolerate being in that environment if that was not part of their job and they were effectively doing so from a goodwill aspect.

    However, I am not sure if it is in their contract to bring the shopping into the kitchen or wherever.

    The driver has gone out of his way to help you in the past, and been rewarded with abuse for his efforts.

    Either write a grovelling apology and beg to be taken back by the supermarket, or just pick another. I wouldn't bother mentioning the law as suggested as that's not going to endear the company any further. If its the same driver and the company values this member of staff, it will be a regrettable "no".

    Personally, I'd realise my bridges were burned and move on.

    I'll quote Asda (I expect they all have similar terms)
    3.6.4 Our commitment is to deliver Your order to Your front door and offer to take it into Your home. There may be circumstances where this may not be possible (including but not limited to):

    where Our driver believes they are at risk of injury;
    where Our driver believes any stairs to Your front door are structurally unsafe;
    where Our driver believes it is unsafe to enter the property;
    where Our driver has not received clear permission to enter the property.
    In these circumstances Your driver may ask to meet you in another location, as close as possible to your front door. If You are unable to meet Your driver in another location then Your delivery may not be completed. You will not be charged if We are unable to successfully deliver Your Goods.


    Doesn't say about putting shopping on shelves & includes a catch all term.
    Or are you saying a non disabled person is permitted to swear at the driver and retain service?

    I do all appreciate your views. Like some of you say yes I shouldn't of sworn. it was down to the discretion of the supermarket manager at the time to feel I should be banned for my conduct on the basis of safeguarding his employees. It is very true there are other supermarkets but this one to me is the cheapest. I did apologise I guess I will just have accept the decision.
