    Small update: Ebay continue to think they are above the law. I received another email today (not sure why) saying if I send them confirmation that my bankruptcy has ended (already done) and pay the balance (NOT happening), they will reinstate my account (I don't want it!) and then consider my repeated requests to close it.

    So basically, pay up or we will continue to chase you unlawfully for this debt.

    I've written to their head data protection officer asking them to delete the account as the debt should be written off, and the phone number and address they hold for me is out-of-date. So surely they shouldn't be kept on file? No response.

    Shame the OR was disinterested when I forwarded Ebay's demands to them. I can't complain, they were very lenient on me during my BR so I don't want to rock the boat..

    I am a DPO and they don’t need to delete your details in fact they legitimately can keep them but I’m not sure on the timescale as my area of expertise is in a different industry.

    Thanks, both interesting points.

    Well.. they don't have my current address, phone number or email (now) and finally I got an 'invoice' which said zero on it so I've kept that one. Looks like they've written off the debt at last, but won't delete my account.

    Since they don't have any of my correct information I would have thought it illegal to keep it, but they are above the law so......!

    Once about 7 years have passed they'd have difficulty justifying keeping your details, although at the same time they might be able to show that retaining them for operational reasons doesn't encroach on your personal rights as a data subject. Although by then we'll have hadd enough companies sued under GDPR to know what they can get away with!

    Hi, Paul,

    Ebay do not close accounts, as such, they allow them to lie unused at there discretion.

    I think this is in case you ever want to use it again, it is in there T`s and C`s how they operate, but at least they have finally gotten rid of the debt.

    I'm a bit sceptical of the legality of that, the GDPR (well, the UK version of the GDPR to be specific) would seem to make it illegal for eBay to keep any data longer than necessary in terms of the purposes for collection (the OP no longer wants an account and the debt no longer exists).
    Art. 17 GDPR Right to erasure (‘right to be forgotten’)
    The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

    the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

    Ebay are above the law! They sent me invoices for the pathetic amount every month throughout my bankruptcy, despite many conversations with them explaining that it wasn't my debt anymore.

    AVOID!

    Certainly 10000000% AVOID ever selling anything on Ebay. There is absolutely NO protection for sellers in their most recent T&Cs. If a buyer receives their antique porcelain doll or second-hand DVD player they can smash it up, swap all or part of it, claim they no longer want it and it goes back to you and the Ebay website automatically issues a refund. You as the buyer are obliged to accept it back WHATEVER HAPPENS, even if you say no returns in your advert and even if it comes back destroyed.
