Can hotel charge me retrospectively if they got bill wrong?

Options
When I checked out I queried that they had added someone else's dinner bill to our final bill instead of our own. As the main course prices looked similar to what we had had and we were in a hurry and hungover, we just settled. Afterwards the hotel has now been in contact to say we owe them more as that dinner bill was less than ours (which is true, we noticed after it hadn't included wine). Can they pursue this though retrospectively?

  • I would say no as it was there !!!! up, don't they give you a final bill and you sign it? Just deny all knowledge of drinking the wine lol!

I'm not sure it's that simple. Whenever I've stayed in a hotel, they've made me sign for any food or wine that's to be added to my room bill, so it's hard to subsequently claim that you didn't have any wine. Also, most terms and conditions state something like E&OE (errors and omissions excepted) which basically gives them the right to chase missed payments after the bill has been paid. Hotels have to cover themselves for instances such as when people steal towels etc. so you can bet your life they won't just let you get away with your wine.
  • I agree it's not simple. Just because a mistake is made doesn't entitle you to benefit from it. After all, if the correct amount had been charged at the time, you have paid it then - so why not now?

You contracted with the hotel that they would provide certain services at a certain price. If they've fulfilled their side of the contract it's jolly difficult to avoid fulfilling your own side.

I'm surprised they bothered, unless you drank an AWFUL lot of wine! But, yes, you owe them

When you wouldn't have owed them IMO - is if you'd ordered e.g. a £12 bottle of wine but they served you a £120 bottle by mistake.

I've also had 'colleagues' sign things to my account when on business trips ... embarrassing to have to explain why ones expenses are SOOOO high!

The E&OE refers to any errors & omitions that may be written in the terms and conditions and does not cover errors made by members of staff.

Suppose it was the other way round and the hotel had overcharged you for your stay & dinner. Would you expect to be able to get the overcharge back after a week?

There's probably a clause in their standard T&Cs that allow them to retrospectively charge your debit/ credit card. Have you had a look through them?
