Requesting a copy of the loan agreement?

I took out a 5 year personal loan 2 years ago and now want to pay it off in full. I requested a settlement figure and it includes a fee of app £100. Notes on the letter say this fee is dependant on your loan agreement, i.e. it may or may not be charged.

Now I'm sure when I took out the loan there were no penalties for early repayment, but I cannot find my copy of the agreement that I signed.

So my question is this, will the loan provider supply me with a copy of the agreement I signed 2 years ago? My worry is their T&Cs may now include a fee for settlement, but I want a copy of the T&Cs in place when I took out the loan, not what's in effect now.

Will they charge for such a request?

I know I can just call them up (and I will), but I'd like to have an idea before I do.

If the loan is a Consumer Credit Agreement the lender must provide you with a copy of the agreement if you pay them a £1.

They have 12 days to provide it. Should they fail to provide a copy of the agreement they will actually be commiting an offence after the breach has continued for 30 days.

They cannot enforce the agreement until they have responded.

That's very useful information, thank you.

Should it be a copy of the agreement I actually signed?

    Yes
It should be a copy of your original agreement, signed by both parties.

I've just got off the phone with the loan provider and my copy is on it's way. There was no mention of a fee, but it did take a little persuation on my part.

At first the operator said I wasn't entitled to a copy as the loan was done over the internet, but I stood my ground. She then got in a little dig about me losing it, but I let it slide. After she passed the matter to her Supervisor and then a different department, she came back to me to say it'll be sent out.

    Thanks again. :T
