2nd Home Stamp Duty Question

Hi all, me and my partner recently purchased a home in November of last year. She had a flat which we haven't been able to sell as yet, and are thinking of renting it out (if we can't sell in the near future). We had to pay stamp duty as it is classed as a second home.
When we come to remortgage our new house (we got a 2 year fixed deal), can I do this in my name only and then reclaim the stamp duty back (as long as it is within 3 years of purchasing)? As long as affordablity stacks up? (which it should do).

HMRC don't like giving SDLT refunds at the best of times, so I would expect that this wouldn't wash with them. However, speak to a solicitor or ring HMRC directly and they will answer your question directly.I am a Mortgage Broker.

Stamp duty is paid at the time of purchase only, not remortgage. So it make no difference I!!!8217;d you remortgage or not, in one name or both or sell the new property. You can reclaim the additional stamp duty if you dispose of the first property though, within the time allowed.0
