Racial Discrimination - Self Representing at Tribunal
Comments

The worst of the discrimination, the incident that they have agreed did take place and was inappropriate was the catalyst for my resignation, I resigned with in a day of this and was told by my then line manager 'I don't blame you'I have a plethora of evidence through emails appraisals etc and the fact my line manager is willing to take the stand that I was always an excellent performer. When i rasied a grievance I also stated that I had always been an excellent performer and this was never contended.
Can I just clarify that your line manager realises that discrimination was the reason you resigned, and they are prepared to take the stand and not only say how good you are but also that the department/company is endemically racist?0 -
What i want from this? To teach people the difference between right and wrong and to try and ensure that my kids do not come home to me devastated about how they have been treated because of the colour of there skin.
How often do we hear this (or similar) on these boards?
The Tribunal might or might not admonish the employer. If the former, the employer might or might not admonish the guilty parties, and if the former, who might or might not mend their ways. Absolutely no guarantees you will get what you are hoping forIf you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -

That is a noble aim, but as you have neither the intellectual ability to achieve it by yourself, nor the financial ability to pay for someone else to achieve it for you; frankly it ain't gonna happen for you.
Furthermore, to think otherwise, or rail against the injustice of it all will simply perpetuate the year of misery you've already suffered.
Racism isn't right, but it still exists. Attitudes are changing, but it takes time. While we still have a long way to go, sometimes it's worth remembering the distance we have come.0 -

Yes he was aware that discrimination was the reason I had resigned and he has said that he has been the victim of this himself and has raised this informally himself and as the company has done very little to fix it he is willing to take the stand and tell the truth. My only fear is that he will get cold feet, I am aware he has more to lose, he is the sole breadwinner and in a very weill paid job. At the stage where this was discussed we were both quietly confident that the company would not let it go to tribunal.0 -

No of course no guarantees, but does that mean you shouldn't at the very least try? And hope that id nothign else you will make someone think before they act/speak moving forward?0 -
Honestly, I want them to be held accountable and to at the very least prevent this behaviour moving forward. The company made me miserable for over a year of my life and continue to do so for many other people.
Dont get me wrong I am looking to be compensated (I am no martyr) but I am aware that there is a potential that I will walk away with very little, my research suggests that I will not walk away with nothing.
In short I want them to be exposed for the racist bullies that they are, and to realise that behaving the way that they have done in a modern workplace is unacceptable and the majority of people feel this way.
Good on you. Good luck.:)0 -

Your Manager will no doubt change his mind if it proceeds to a tribunal leaving you high and dry. Self preservation no doubt will kick in.0 -
Hang on...do you want your day in court or a settlement as you have said two differing comments? In order to be ‘quietly confident’ you will need to disclose enough of your ‘evidence’ - you might find your ex manager becomes less likely to support you then as they try and save their own skin.0

No harm in trying, but as I said it might not have the desired effect. Your problem will be getting someone willing to corroborate your story and be prepared to appear at Tribunal. If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -
