Hi everyone,
I'm new so sorry if I do anything wrong!
I have in the last couple of months received a couple of letters for debt collectors - one regarding an EE bill (small amount) that I am not aware of - I didn't know about a proof of debt letter until after the time period, I was waiting for another letter to reply to that - as of yet not received. Another is in regards to a Lloyds Planned Overdraft I had years ago but honestly thought I'd paid off. I was young when I took it out (£190) and noticed it disappear a few years back, being terrible with money at the time, I thought I had just left enough money in my account that it cleared and they removed it. Thinking back that is very naïve! I received the letter a few weeks back but have suffered awfully with my health and haven't replied yet. I'm a bit frustrated actually as it's the guest I've heard despite Lloyds always having my contact info and visits to the branch.
So today I received a text from a company called Resolvecall stating: "We have not received contact from you following our recent visit to your property. Please contact us on 01412128475 quoting ref number ........ urgently." I am so worried!
I have had no letter from them at all, no note/letter was left when I returned home, I rang in hope of getting some answers but refused to give my name so they couldn't do anything other than say "well we have no control over what happens to your post" !!!128529; as my name isn't on the text I don't want to start conversations with then without knowing what this is in regards to.
Any advice? I'm happy to start a payment programme but I don't have a lot of spare income right now due to emergencies that have cropped up in the last month or so. I'm terrified of speaking with debt collectors as I've read how horrendous they can be!
I once dealt with a lovely debt collection agency who accepted what I could afford but I'm worried what I can afford won't be sufficient. I was trunks with money when I was younger due to very unfortunate circumstances but cleared what I knew about but I worry what is left! It's all very daunting
Any and all advice appreciated!

Hi,
First off you do not need to respond to texts, calls or spam email.
A debt is only legally valid when you are written too about it.
Even then you never pay someone for a debt that may not be yours, you respond with the provit letter.
Based on their response to this, you may want to make an offer of payment to them, you do a budget, and whatever you have available for debt repayments is what you offer them.
Debt collectors are just that, nothing to be afraid of, its neither daunting nor worrying, its simply business, they have no more power to do anything than you or I do.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thank you! It's seems daft to be so worried as it seems a relatively small debt ATM. It's so frustrating that a few years back I made poor decisions (admittedly due to a bad situation at the time!) and thought I was moved on but it's still there! I kept no track of my debts so I have no idea what may or may not be mine.
Thank you for your advice.
So wait to see if they write and if so respond with a provit? I think there is a template on here, I may save it in readiness so I can send straight away.0 -
Hi Ds1991
You'll find the prove it letter here
https://forums.moneysavingexpert.com/discussion/2607247
You also mention the debt is years old. Is it possible there has been more than 6 years since the bank called the overdraft in? If it is and during that time you haven't acknowledged the debt in writing, no payments have been made towards it and there is no CCJ, it's possible the debt is statute barred. That means they have run out of time to collect the debt.
You can still send the prove it letter, but if they can successfully prove it's your debt you may still be able to argue there are out of time to collect the debt. Keep us posted on how you get on.

I had a visit one week ago from these people which is very unusual indeed from Debt collection agencies. I wasn't in at the time but they left one of their ridiculous call us at the earliest opportunity, maximum urgency cards.
The reason? In cahoots with good old Cabot financial chasing a thrown out of county court and now statute barred account for about £360! Dating from around 2012
I emailed them ( Resolvecall) warning them that any further visits are denied under the implied access law (template letters freely available online) in other words they must make an appointment which isn't granted and the promise of police action should they disobey.
Everyone has a right to do this regardless of the status of what they are chasing as they aren't bailiffs , therefore have no legal powers and no right to be there whatsoever and can be told to leave.
I received a call us text in the meantime which I voice texted back to say read my email.
Email back this morning from them to say they're no longer dealing with the matter and they've referred it back to Cabot! Good luck Cabot chasing statute barred debt , you haven't a hope.
These people can be beaten , stand up to the bullies!0 -
I’ve had a visit from these guys today despite sending them an email Based on the template this post is linked to. I genuinely have absolutely no idea what it is about and after confirming who I was the guy visiting had virtually no information other than the value of the debt and another collection agency called lantern......now my wife is stressing about people turning up at our house unannounced, I can’t give her answers and it’s stress I could do without.........any advice on what to do next would be appreciated.0

They are not bailiffs and have no rights to anything. You were unlucky to have anyone turn up. It's a really rare occurrence because it's unfruitful for them.
If anyone else turns up, ask them to leave and if they don't, phone the police
What I suggest is to start a new thread and send a prove-it letter as a response to any letter you get from them.0 -

Hi,
Lantern, used to be Motormile Finance, they specialise in things like old payday loans, phone contracts, etc and originally old car loans.
Wern`t you lucky getting a doorstep collector, they are quite rare these days, with the advent of youtube, lots of people tend to record them, and upload it to the internet.
These people are just self employed collectors, who get paid by results, its a very un glamerous job, but they can sometimes be pushy and exagerate their "powers" (which are zero by the way), best to keep them on the otherside of the door and just tell them to go away.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
