Need A Rant Ref Oil Leak

As some of you may know, my oil tank decided to sping a leak in June and leak all over next door garden, cellar, brick work etc.

Well we were repeatedly told that we weren't covered for the tank as that was wear and tear, but we were covered for the remediation of the ground our side and next door. Phew we thought.

Well it has been getting colder here, and we have been getting increasingly worried about pipes bursting as we STILL have no heating/ hot water. So phone the insurance company to prod a bit today.

Only to be told that the underwriter is querying the decision to pay out on the remediation work. To say I am P****D OFF is an understatment. This work is going to cost thousands of pounds, just for our side of the fence. How can it possibly be right that the work is nearly finished (one more bacterial treatment and putting the earth and the path back), and NOW they want to back out.

We are completely panicking now. We can't sell the house with out the certificate to say the ground has been treated, and we can't get a new tank in until the ground has been put back, so we can't rent it as we were planning to do whilst out in New Zealand.

I am so totally FURIOUS :mad: :mad: :mad: :mad: that this can happen. I mean it is not as if we have had any warning. We have been told over and over again (sadly verbally) that we are covered for the remediation side of the problem.

Sorry I just had to rant. It was either that or go to the shop and buy 20 fags - I haven't smoked in 10 years. And just as I was finally on the way up with my depression too. Was going to ask DR about coming off the meds. Hope this doesn't knock me back down again.

    Hey hun, virtual hugs may be all that I can offer, but offer them I will in abundance!

    If you have had verbal assurances, then ask for the relevant tapes of the phonecalls to be pulled and for them to be listened to. This may help them in their "decision" if you have been repeatedly told that it will be covered.

    In the meantime, take a deep breath, and count to 10.

    Aw hugs Chev. I remember the blasted leak in the summer and can't believe you've been stitched up.:grouphug: :grouphug:

    But write down whatever you can remember of any phone call you've had with them. Dates or names or anything. They should keep records of phone calls and what was discussed. You have obviously behaved as you would if you were expecting the payout which will count in your favour. If payout was discussed; even if their records stated that you were warned that there was a chance you wouldn't get it (I don't trust anyone anymore, :o I'm sure that they could edit their records to say that.....) the fact that you *behaved* as if you were expecting it should count in your favour.

    I hope the underwriter sees sense. Why would you not be covered? I wonder if you phoned a salesman and asked them hypothetical questions "if this happened, would I be covered? even if the tank was old but not noticably corroded? etc" what would they say?????
  • aww hugs for you..did the insurers arrange for the work to be done? If so that would imply that it was covered! I would suggest seeing if yu can get some legal advice and then correspond in writing & threaten them with the ombudsmen if ecessary and see if that helps. What does your policy wording say & do you have liability insurance under your buildings as that should surely cover any damage next door - thats why you have it after all, which I'm sure you know!! B***** insurance companies...

    Hi yes the loss adjuster was arranged by axa and the loss adjuster arranged the remediation people.

    I just so want to swear at the guy on the phone, but it isn't HIS fault his company is a bunch of appendage manipulators! Right going for a beer....

    Aww poor chev...I don't believe it...how dare they ..I don't think they have a leg to stand on as they arranged the works!!!!...name and shame the insurers as well...so none of us do business with them...
    Sending you big hugs from this end..I can't believe the cheek of them and hope you manage to get it sorted soon
