I have a debt originally from Barclaycard. This was sold to LinkFinancial a number of years ago - around 6 years I think. I have been paying an agreed amount (only £8) a month without fail by standing order. They have recently been phoning and texting about an outstanding amount. I ignored all of these until they finally sent me a letter telling me that as I had stopped making payments they had cancelled the agreement and I must phone them. I wrote back telling them they are wrong and to check their records and confirm that the agreement has been reinstated. Since then I have had more phone calls and today one from a company called CapQuest. I have no intention of phoning anyone and I do not deny the debt. I could even increase the payments slightly now but I don't want to get a CCJ against me. Should I do anything more or wait for Link to reply to me in writing as I requested?
Or will capquest write to me eventually.
Can they take me to court even though I have been making payments.
As an aside my credit rating has miraculously now improved to be really quite good which I don't understand. This debt is around £3500 and I have another of around £14000 which I am paying an amount towards as well. When I last checked my credit report, probably about a year ago I had a terrible credit rating and these 2 debts were showing as defaulted.
Or will capquest write to me eventually.

Hi there,
It is possible that Link has passed/ sold the debt to Capquest and you may need to deal with Capquest from now on. However, I agree that you should've received a letter stating this. If the standing order at the bank was never cancelled then you can raise a complaint with Link about the harassing calls and texts. Explain how you would like them to resolve the situation and escalate the matter to the Financial Ombudsman Service if they don't do this.
Unfortunately, there is a risk of county court action, but not because it has gone to Capquest, it has always been there. Informal arrangements do not prevent the creditor taking county court action. If you get claim forms then make sure you get advice from one of the free debt charities. If you can improve the payments, do a new SOA and make a new offer to try and clear the debt quicker, the quicker it is cleared, the less chance they have to go to court. However, before you make any more payments, ask for confirmation, in writing, of who is dealing with the debt now.
