Hi all.
I have sent this one to the CAB but wondering if anyone on here can give me any insight.
As you may see I have had this problem before. Long story short I started my current job in Jan 17 for what was supposed to be a year long contract for maternity.
In October they fired 5 out of 7 of our team and kept myself and one other person on. I imagined it was as I would be told to go in January 2018 when my contract expired as the person who I was covering was also not coming back to work.
Basically, I asked for an up to date contract as they told me I would not be being let go and I am still here. No word on this contract but anyone they have fired they have paid off rather than make them work their 4 weeks notice. If they were to fire me tomorrow I would get absolutely nothing in regards to a package as far as I can see.
My question really is, I have an agreement to work here but I do not actually have a contract that says I have to give 4 weeks notice as it expired on Jan 31 2018. If I were to be offered a new job, would I have to give 4 weeks notice or the standard legal amount of one week? There is no valid contract in my eyes to require me to work 4 weeks if I was to get a new job.

What do you want the answer to be, and why don't you think you can amicably agree with your employer a solution which works for both of you? Also, what was the notice period for the maternity cover?
Any new employer worth their salt will honour your current notice period, so unless you honestly believe that having a week's notice period makes you a far better candidate, or (conversely) having a month's notice period makes you an extremely unattractive candidate, I don't see an issue with telling any new employer that you're on a month's notice. And if they can't wait, or want you to break that, they're probably not worth working for.
You seem like you're determined to engineer a conflict rather than come to an agreement; in which case, whilst you want to hope for the best in terms of a week's notice, you need to prepare for the worst in terms of the current lot holding you to a month (or whatever period was stated in the contract you previously had). But if you can establish the position before push comes to shove, than that's the best outcome for everyone.0 -
Your existing contract T&C stand.
everything rolls over the only thing that has changed is there is no end date as you continued working, they let you and paid you.
The notice periods in that current contract is what you use.0 -
