  • Hi again,
A quick update on progress after the help I received here, and a question...
Update - I've applied for 12 jobs so far, three close this week so fingers crossed! More applications pending too.
Onto the question: I've sent each DCA a CCA request, with postal orders via signed for mail. What happens next?
I'm just panicking now that I've stirred a bees' nest and they'll start court action. Does that happen often? Sorry if it's a stupid question.
I don't know what I would have done without this site this past week. I've been reading the diaries and it's made me feel a lot less alone.
Thanks if anyone can help with my question.
    Alex

Don't worry. Now that you have sent the CCA requests, the DCA's cannot start legal action until and unless they have complied with your request. That means, until they can prove the debt legally exists, they are prevented by law from taking legal action against you.

I don't know how many CCA requests you have sent off. but chances are some will return your PO's automatically, some will ignore your request, and some will write and tell you that they cannot comply.

Wait until the responses start to come back to you, and let us know. Until then - don't worry. You've taken the first steps into helping yourself to a much better financial future.

  • Thank you poppasmurf. That's very clear to me now and I appreciate your speedy reply.
It's three requests I've sent, so I'll wait to hear from them and then post back here with what they send. So glad I have this forum and all the people with knowledge to turn to.
I can't thank you enough for your help and advice.
    Al :-)

I hope you're feeling better about the debts now - nearly all of us on here have or have had them at some point.... absolutely nothing to be ashamed of.

i had one loan with lloyds from 1999 (ish) that I'd be paying until 2 years ago when i requested the CRA, they could not provide me with the documentation so it has been written off.

i wish you the best of luck and hope the same happens for you!

I do work full time, self-employed.

Might be time to accept that the self employment isn't working and get a regular paid job. 40hrs minimum wage job now pays £314 a week with a take home pay of £278.54 and you'll get a mandatory workplace pension as well.

Yes Tarambor, sadly I've got to let my business go, but (finally) sensibly I'm applying for all sorts now, 12 so far, two more to send today and more to complete later in the week. Fingers crossed.

An information request under sec 77/79 consumer credit act is one of your statutory rights in law, and cannot be used to your detriment.

Your creditors will respond to you at there own pace, remember, until they do respond to you, all accounts are temporarily unenforceable in court.

  • Thank you again sourcrates.
    Another question - sorry.
Do I keep paying my £1 per month to each DCA while I'm waiting to hear back?
    Thank you.
