I want to (wanted to) employ a guy for the few hours a week he wanted to work and do the right thing.....ha....

hes on UC and i can give him £115/worth of hours (2 days/week) work at a rate above the NMW, so all good...

no

i cant register as an employer as his weekly wage is under "the level"
and i cant register him as an employee as his last work was as self employed back in march

so, should he fiddle and work cash in hand?

I was going to use a "Full payment submission" (as he wouldnt fall due to tax/stamp in any great amount) but all im doing is going round in "HMRC" circles

    Why can't he do the work as self employed and invoice you for payment?

    Do you have to register as an employer to pay him as an employer? You still keep records but if there's nothing to pass over the HMRC then ...

    And what difference does it make if he was self-employed previously? (Quite a while since I did my own payroll ...)

    and agrinnall's suggestion is a possibility, although I'd respectfully suggest that if you're doing that, you'd a) need to ensure he was legitimately self-employed in the eyes of HMRC and b) pay more than you were intending to cover the paid leave he won't then be entitled to, and his pension contributions etc.

    BTW, HMRC used to have a new employer's phone line, and they were always quite helpful!
