Company House late filing and debt recovery

I posted on here a while back about debt company, Daniels silverman who were chasing me for a payment for a month I didn't use in a gym. They have stopped contacting me since, and I didn't end up paying.

I setup a limited company last year with companies house that I haven't traded with yet since. I received a letter in late January alerting me to a late filing for an overdue confirmation statement, so I quickly went online and completed it. Apparently, I was 1 day late to file, and they charged me £375, which I refuse to pay. I don't trade from this company and I didn't see the letter until very late. The debt has been passed to a company called Akinika who are bombarding me with letters, reminding me of the legal requirements of filing, and demanding I pay the money to them.

I'm not really sure what to do at this point, but I don't want to pay this fee. Any suggestions? They are threatening to get their solicitors involved, but it doesn't seem realistic for £375.

    One company took an individual to court over £15 a few months ago, yep, you read that right £15.

    Unfortunately its anyone's guess if they will carry out there threat, its often used as a method of leverage in order to get you to pay.

    I am not aufair with business practices or legal obligations within that sector, but i do know about debt collectors, they will make a lot of noise, usually that's all they do, but further action is always possible, its not like you can ask for evidence of the debt either really is it, or can you ?

    Can they prove it was paid late ????

  • They will pursue you, and can sanction your company.
    Whether a company trades or not it is legal obligation to complete and penalties are a sliding scale of how late the submission was made.
    If you apply to have the company struck off (given that you're not trading) the fine used to "die"- not sure if that's still the case.

    Call and ensure everything is correct firstly. That seems high for a late payment charge.
    I had a letter this week for £130 I think it was (late filing) however after calling them it turned out to have been sent in error. Automatically generated after modifying a payment plan which made it look like payments were coming in late. The lady was lovely and wiped it for me without any issue.

    Remember the staff are just normal people like you and me. They will help if they can.
