Conditions of entry

1. This prize draw (the "Promotion") is only open to UK residents, excluding employees and agents of (a) the Promoter (b) Thomas Cook Group, (c) any affiliated company of the Promoter or Thomas Cook Group or (d) any company connected with the production or distribution of this Promotion, as well as their direct family or household.

2. Entrants must be aged 18 years or over at the time of entry. Proof of eligibility must be provided upon request. By entering the Promotion you are deemed to accept and be bound by these terms and conditions.

Promotion

3. The Promotion is free to enter. Entrants can enter by visiting http://www.dailymail.co.uk/manos-holidays and by submitting their full name and valid email address in the entry form provided. Entrants will require access to the internet to enter. Only one entry will be accepted per person or email address.

4. The Promotion will start at 10:00am on 19th March 2018 and the closing time/date for the Promotion is 23:59 on 17th May 2018.

Prize

5. The prize is a Thomas Cook E-Gift Card worth £1,000 (the “Prize”).

6. The Thomas Cook E-Gift Card may be registered, redeemed and used in accordance with the Thomas Cook E-Gift Card terms and conditions, a copy of which can be found at https://www.thomascook.com/gift-cards/.

7. Thomas Cook E-Gift Cards can be used across all Thomas Cook stores and The Co-operative travel branches on selected products excluding travel money. They can be used against selected holidays at https://www.thomascook.com and https://www.airtours.co.uk, and against sport breaks at https://www.thomascooksport.com.

8. The Thomas Cook E-Gift Card will expire 24 months from its date of issuance and must be redeemed by the winner prior to such date.

Winner

9. There will be one winner who will be selected in a random draw by an independent judge from all eligible entries, held on or around 18th May 2018. The winner will be notified by email within 5 days of this date and will be given details of how to accept their Prize. Failure by the winner to accept the Prize in the manner specified within 14 days of the notification email will make any claim invalid and another winner shall be selected (again randomly in a draw) from all remaining eligible entries, who will be contacted as above.

10. The winner will receive their Thomas Cook E-Gift Card within 14 days of notifying the Promoter of their acceptance of the Prize.

11. The Prize is redeemable by the Prize winner only.

General

12. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry.

13. Gifts, prizes and other promotional items are not transferable, may not be re-sold and are subject to availability. The Promoter and Thomas Cook reserve the right, in their reasonable discretion, to substitute any such gift, prize or item with a gift, prize or item of equal value.

14. The Promoter accepts no responsibility for any costs associated with the Prize not specifically included in the Prize.

15. The name and county of the Prize winner will be available after the closing date for a period of 12 months by submitting a written request to the Promoter.

16. Entrants agree to provide reasonable cooperation to allow the Promoter to use the name and/or likeness, county and country submitted by the winner for advertising and publicity purposes in connection with this Promotion including but not limited to publication of the winner's name and photograph on the Promoter’s. In addition, by submitting an entry and in consideration of the Promoter granting a right to enter the Promotion, entrants agree to grant the Promoter a worldwide, perpetual, royalty-free, non-exclusive, irrevocable, sub-licensable right and licence to use, license, edit, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and exercise all copyright and publicity rights with respect to any materials (or portion thereof) contained in the entry (including but not limited to text, images or video materials) (the “Materials”) worldwide and/or to incorporate the Materials in other works in any media now known or later developed, including (without limitation) on any websites or social media pages of the Promoter or any of their respective affiliates or subsidiaries for the full term of any rights that may exist in the Materials. By submitting Materials to the Promotion, an entrant:

a. warrants that it has all necessary permissions and consents from third parties to grant the rights under this clause;

b. warrants that the Materials are its own original work and that it has the right to make them available for all the purposes specified above; that it does not infringe any law; that it is not obscene or libellous; and that it does not violate the rights of any third party;

c. agrees to indemnify the Promoter against all legal fees, damages and other expenses that may be incurred as a result of a breach of the above warranty; and

d. agrees to waive any moral rights in the Materials to the fullest extent permitted by law.

17. The determination and decision of the Promoter on all matters shall be final and no promotional correspondence or discussion will be entered into. The Promoter reserves the right, in its reasonable discretion: (a) to disqualify any entrant, claimant, competitor or nominee whose conduct is contrary to the spirit of the rules or the intention of the Promotion and/or to these terms and conditions, and to declare as void any or all of their claims or entries based on such conduct; (b) to add to or to waive any rules on reasonable notice; and/or (c) to cancel the Promotion or any part of it at any stage in the event of circumstances beyond the Promoter’s reasonable control.

18. No entries will be accepted in bulk, from agents or third parties.

19. To the fullest extent permitted by law (and subject to paragraph 19 below), the Promoter hereby excludes all warranties, representations, covenants and liabilities (whether express or implied) relating to this Promotion and/or the Prize.

20. Nothing in these terms and conditions shall exclude any party’s liability for: (i) death or personal injury as a result of its negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be limited or excluded by applicable law.

21. The Promoter reserves the right, in its sole discretion, to modify, suspend or cancel the Promotion should virus, bugs, tampering, fraud or other causes beyond the reasonable control of the Promoter corrupt or hinder the administration, security or proper play of the Promotion.

22. This Promotion and these terms and conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with English and Welsh law and you can bring legal proceedings in respect of this Promotion and these terms and conditions in the English and Welsh courts. If you live in Scotland you can bring legal proceedings in respect of this Promotion and these terms and conditions in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of this Promotion and these terms and conditions in either the Northern Irish or the English courts.
