Resignation Letter

I believe I will be dismissed for gross misconduct, I am on suspension currently but I want to resign before it happens.

Does anyone have a template resignation letter that I could use?

I need to ask about my final pay, my outstanding holiday and hopefully come to some agreement about a future reference and wish them all the best.

    I hate writing these types of letters so the job board reed or i-resign.com have templates which could get you started.

    I always have it in my mind less is better with resignation letters.

    Searching 'resignation letter templates' will give you lots of options. Given your situation you aren't in a position to make any demands, so you would really need to speak to those in control at your current employer about the likelihood of them providing a neutral reference. I would suggest that a positive one is unlikely with a gross misconduct accusation hanging over you. Handing in your resignation, if it hasn't been offered as a potential way out by the company, is about as close to an admission of guilt as it comes.

    There will be no template to cover all you want to say and negotiate.

    I would recommend you seek specialist advice before writing anything.

    For one thing, to check that the action you expect to be dismissed for actually is gross misconduct. I didn't read in your other thread if you explained what you had allegedly done, however, just because an employer terms an action GM, doesn't mean it actually is.

    This may not help you keep your job, but a downgrade to misconduct is better than all that GM could suggest to future employers (theft, violence etc) and will at least require they give you notice/pay in lieu.

    Depending on the relative financial value of your job it may be worth investing in the advice of an employment solicitor to advise you on the best possible outcome in the circumstances and how this could be achieved.

    Even in a weak case, sometimes employers will decide it's cheaper to come to an arrangement than to deal with the hassle and expense of a fight.

    However, you will need to weigh the cost and benefits of this, as its unlikely to be cheap.

    An alternative is ACAS, but the advice is likely to be more generic.

    Citizens Advice may be able to refer you for an initial free interview with a solicitor to help you better understand your options.

    Dear sir or madam,


    I hearby wish to tender my resignation as I do not wish to be involved any further in the disciplinary action concerning myself that you are currently undertaking. I also expect to be paid the maximum possible under my notice period.


    As you know, I currently have one of your assets, namely a company car, and I also wish to retain it for as long as feasible.


    Finally, I would like a good reference and trust you will have no problem in providing such to any potential future employer of mine.

    If you must write before getting advice, change the first sentence to:

    'As I feel the relationship of trust between employee and employer has irreparably broken down as a result of the pending disciplinary action against me, with regret, I see no option but to tender my resignation....'

    Then seek advice.
