DCA CCA not returned what next?

    Guys - an update:

    SMILE: The DCA responded to my letter (07/02/08) advising them that the debt was unenforceable on 22/02/08 advising me that are awaiting information from their vendor, and that if i need to contact them I should contact the Compliance Dept. All very meaningless. As a reminder Smile have not provided me with the CCA since I requested it in Aug 07. Do i sit back and wait, or pursue it?

    EGG: I received the necessary CCA a day before they would have committed an offence. So, I will offer a pro rata payment, is the following letter okay:

    I acknowledge receipt of the signed card agreement and statement of account. However, I have not received formal notification from Egg Banking Plc that the account has been assigned to DCA.

    I am currently in financial difficulties because of:

    I am taking advice from the Consumer Credit Counselling Service (CCCS) to sort out my financial problems and now enclose my ‘List of Creditors’. My CCCS client number is XXX.

    After payment of my living expenses, I have only £XXX with which to make repayments to all my creditors.[/font]

    On a pro-rata basis, I am able to pay you a regular monthly amount of £XX. The first payment will be made shortly after receipt of notification that Egg Banking plc have assigned the debt to DCA, and monthly thereafter.

    Please let me have your written acceptance of this offer as soon as possible, and give consideration to reducing or freezing the interest & other charges on the account.

    Thank you in anticipation of your kind assistance. I will write to you again as soon as my circumstances change and I am able to pay more.
    Debts at 02/02/20: c£225,000 inc CCs of <£1000 repaid in full monthly
    Debts at 14/07/10: £278,091 inc £24k unenforceable and £16k consumer debt. But House no longer derelict!!!

    Another update:

    SMILE Overdraft: I sent the first CCA letter on 30/08/07. Heard nothing until Jan 08. Sent second 'offence committed' letter on 07/02/08. Still haven't heard anything. What now?

    C1: Again, 1st CCA Letter sent 05/02/08. Today 23/03/08 is the last of the 12+30 days. So CCA 'offence' letter ready. Can i reclaim all payments made to C1 since the card was opened or just the payments made to the DCAs?

    Also, what is the compensation under s10, s12, s13 of the Data Protection Act? As per Weller's post.[FONT=&quot][/FONT][FONT=&quot][/FONT]
