Question regarding 'durability' of item

Hi there,
I purchased a concrete magazine rack in November.
Last week the cat knocked the magazine rack over (it was sitting on the floor as you would expect) and the rack split in two.
My question is whether I would be entitled to a replacement or refund as I consider the item to have failed the durability test. If I had purchased a plastic, wooden or metal magazine rack, I would not have expected the rack to break the first time it fell over.
Ironically, the company originally sent me 2 racks by mistake and I was honest enough to inform them and have them collect the extra rack. I wish I hadn't now!
I should point out that the magazine rack costs approx. £150 so is not a cheap item.
Any advice gratefully received.

I don't think you have an argument with durability imo. It would be a bit like claiming a window wasn't durable after you took a hammer to it and smashed it. Obviously the window would have been durable enough for its purpose, but not durable enough to withstand everything. This is the same (again, imo), if it was durable enough to hold magazines then it was durable, the fact its not durable enough to be knocked over by an animal doesn't come into it because thats not its intended purpose.You keep using that word. Can we see a link to this particular magazine rack, where did you buy it from?
TBH, unless it fell from a height or onto a hard floor I wouldn't expect something made from solid concrete to break in two if knocked over on carpet, unless it hit something else.

the retailer was The Hut. i'm not sure of they have a good reputation or not.
i have wooden floors so unfortunately no carpet. i agree though - the rack itself is only 30cm high so not exactly far too fall.
had the rack been made of wood, metal or plastic i would have expected nothing more than a scuff. i mistakenly assumed that solid concrete rack would be stronger.

Not necessarily less stronger just completely different characteristics, ie, brittle. However, I would expect it to take a bit of a knock before breaking so I'd be inclined to contact the Hut regarding this as it doesn't sound to be that durable.had the rack been made of wood, metal or plastic i would have expected nothing more than a scuff. i mistakenly assumed that solid concrete rack would be stronger.0 -

as you may have guessed, i have already contacted them and they are not being very helpful.
as i mentioned previously - all very frustrating because they originally sent me 2 by accident and i was honest enough to get back in touch with them to ask them to collect the extra one.

I'm actually not surprised at all that a rack of that design has broken when knocked over, that is thinner than even really cheap and basic patio slabs and they are very easy to break when laying them even on soft cement or sand, I wouldn't be surprised if it broke falling on carpet let alone a solid floor.0
