Robinson Way Debt

I would appreciate a little advice if possible. I've just received a letter from Robinson way recently stating that i owe them money for an old debt. I've checked on Equifax and the date of default was June 2012. It was marked as GONE AWAY - Customer has left the address provided without supplying a new address.

I've read a few things about it and it seems statue barred becomes active after 6 years from the last payment, I have no idea when the last payment was made but I would presume it would have been several months before it actually defaulted. Does this mean I am over the 6 year threshold?

How do they get my new address when I've moved probably 4 times since? :mad:

    Hi,

    Its called tracing, you always leave clues somewhere when you move.

    My first instinct would be to send the provit letter, as you are unsure of your exact dates, you can send that without officially acknowledging the debt.

    See what they come back with, by the time they have done that, time will of passed, so the SB defense may be more relevant.

  • I received a letter from them and its say HPH ex black horse I do not know what this is. Can anyone help its for over a £1000 and not on my credit report

    It sounds like Robinson Way may have bought an old debt that was originally with Black Horse. If it doesn't show on any of your credit files (check with all 3 agencies) that suggests it is either more than 6 years since you defaulted or possibly not your debt.


    You can start by sending a prove it letter
    https://forums.moneysavingexpert.com/discussion/2607247. They'll have to prove the debt is yours before they can take any further action. If they do prove it's yours they could still be out of time to collect the debt. Let us know how they respond to the letter and we can advise on your next steps.

  • Be careful with Robinson Way, I sent them the prove it letter for a statute barred debt that no longer showed up on my credit records etc. They sent a letter back claiming it wasn't barred as I had apparently entered into a payment plan with them 3 months off 6 years ago and even 6 years ago it was already barred as it's a really old debt. Total BS as I had no record of it.

    But since this letter they seem to have stopped sending me letters anyway. Touch wood.

    It would also help if you could send any supporting documents that will aid us in resolving your dispute.


    What would be my next response to this? Seems like they don't have any details on the debt, and they are fishing for me to give them some.

    If so your dispute is quite clear. The letter states you do not know anything about the debt and asks them to prove it is yours. You can respond reiterating this (be careful not to acknowledge the debt) and explaining you will be complaining to the Financial Ombudsman Service (FOS) if it is not resolved.

    Ah, its just Robbers way wanting to play games with you, as Suzie says, the "Provit" letter is fairly clear in its content (its especially worded to be that way).

    Write back to them, tell them that the nature of your dispute is quite clear, and that you believe they are being deliberately obstructive sending this response, but for the avoidance of any doubt, you do not :

    (A) Acknowledge any debt to this company,

    (B) Have any knowledge of this account at all.

    Remind them of Conc 7, FCA Handbook.

    7.5.2 A firm must not pursue an individual whom the firm knows or believes
    might not be the borrower or hirer under a credit agreement or a consumer
    hire agreement.
    .
    7.5.3 A firm must not ignore or disregard a customer's claim that a debt has been
    settled or is disputed and must not continue to make demands for payment
    without providing clear justification and/or evidence as to why the customer's
    claim is not valid.

    So in order to ascertain your position, you require Robinson Way to provide you with written evidence of your liability for this account within 14 days of the date of this letter, otherwise a formal complaint will be registered with the company, and also the Financial Ombudsman Service.
