Hi everyone
This is my first time at this chat room stuff....
I had a letter from a DCA (Lowell Financial) in July wanting £600. I asked for some proof. They have just sent me a statement (took them 3 months to sent it) from, they say Capital One but there is no names on the statement just dates and figures. The last purchase was 12 Oct 2001. After this date is late payment charges.
Please can anyone tell me how to reply
and if the 6 year thing apply's.
Many thanks

How did you ask for the proof? Did you acknowledge the debt in writing?
This is a debt that could well be covered by the Limitations Act.
Read through the info at: http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=25_liability_for_debts_and_the_limitation_act
If you have not acknowledged the debt in writing by you or by payment by you for a period of 6 years then the debt is "Statute Barred" under the Limitations Act.
If you think this applies then you can send the letter at the end of the above link and that should be the end of the matter.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Hi
I sent a letter to DCA on 2nd Nov asking for credit agreament etc.
I've not had anything back yet.
Should i chase them or now for answer???
Can any one help?:j0 -
Don't bother chasing them just sit and wait because they will be back. Nothing surer. It wouldn't suprise me if this gets passed around a number of Debt Collectors but as you have already put this into dispute with one they are acting against the OFT guidelines at the very least. The debt is in dispute don't do anything until they come back with the Agreements.in the mean time............Check out the Consumer Action Group forum for some excellent advice, letter templates etc.I'm Debt Free :j 2/09/2013

Somewhere around this board is a template for a further letter you can send informing them that they have committed a criminal offence, by not meeting your request, you should also report them to Trading Standards and the OFT regarding their failure to comply[strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j

Just send a copy of the 'statute barred' letter to both Lowell and MacKenzie Hall.
I do not think that they are 'the same company' but they certainly share the same DNA.
Make sure you send the letters by recorded delivery.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
