Surely if he is on the birth certificate he HAS to give permission for a foreign holiday you can't take them without it. If he isn't then he doesn't have the right to give permission or refuse either.0

Your missing the point. The father has threatened legal proceedings if he is not on the BC in order to establish his parental rights. That is not something that the OP can avoid dealing with.0
