This was posted in another forum, but was recommended that i move it to this forum.

I am posting the following on behalf of a friend, it has been put on another site, but in an effort to reach a wider audience, i offered to post on here too. Any advice would be greatly appreciated.

hi every one. I am new to this today but i have been reading and sifting for last 4 hours though all the threads and this this thread is the on i thinkwill help me.

Here is the short short story:

got an egg loan online summer 2005

had problems with work fell behind on payments

last month i got a letter (creditor's notice) from capquest saying that i may get taken to court in 7 days if i do not pay the amount in full. The amount on the letter is about £150 higher than the amount i had outstanding.

i rang them and asked who they were as egg never informed me of any action they were taking and they just demanded loads of money which i couldn't pay them.

Is my next play to ask for the cca from them, if so what do i do next?

help will greatly be appreciated.

    Communicate in writing only, write and advise them of this, recorded delivery.

    Read the OFT Guidelines for Debt collection; they cannot force you to pay more than you can afford after paying priority debts and reasonable living costs.

    post up a Statement of Affairs so that the folk here can help you reduce your spends and pay off you debts more effectively.

    If you just write down all your monthly outgoings (rent/mortgage, insurances, phone, gas, elec, council tax, water and any other regular monthly payments you HAVE to make) then put down what you have coming in.

    There are some genuises on here who can spot a mile off where you are overspending and will show you some great ways to cut your outgoings so you have more to put towards your debts.

    Re the capquest letter, my OH got one re a debt he knew nothing about so I've sent a recorded delivery letter with a £1 postal order (didn't want to send a cheque and give them our bank details!) asking for a signed copy of his agreement. Got the template letter from here.
