Compassionate leave and pay

When I had my daughter I stopped working full time and started working 3.5 days a week. After a few months I offered my employer to work in another branch for 1-2 days per week as well as the regular 3.5 days in the first branch. I didnt want to commit to a set number of days as in this second branch as I didnt know if I would need to take time off if my baby girl was ill etc. I said I wouldnt claim any sick leave and he need only pay me for the days I worked at this second branch. He was happy with this and increased my standard rate of pay for this second branch to cover for the 5 weeks annual holiday and for 5 bank holidays I would miss out on by just claiming for the days I worked. As it turned out my daughter was never ill and I never took sick off and have been happy claiming for 1 to 2 days extra work at the higher rate for 15 years.

Last year my father died and I took 2 weeks compassionate leave. My employer paid me 2 weeks pay but only for the first branch where I work 3.5 days a week. I found this uncompassionate and a bit mean. Do I have any rights in asking for the pay for the second branch to be included in the compassionate pay, say an average of the 1-2 regular days a week I work? I should say that my employer also pays a weeks wage as a Christmas bonus and I have only ever been paid for the 3.5 days I work in the first branch.

    You need to refer to the employers leave policy but seriously, I wouldn't push this.

    It sounds like you have 2 contracts, one employed for 3.5 days and one self employed for hours as required.

    In my view, your employer has been extremely generous giving you 7 days (2 weeks) compassionate leave. When my father died, I got 3 days paid (and I am employed full time).

    Sorry to hear of your loss - appreciate that it must have been a difficult time. However, I completely agree with the comments above - don't push this. Sounds to me like your employer is a very generous and accommodating company and it's absolutely not worth you damaging your relationship with them by debating 3 days' pay...

    If you do really need to recoup that money, a better solution could be to ask whether you can do 3 extra days as overtime over the next few weeks?

    I agree that your employer has been generous. You are only contracted for 3.5 days per week and that all that should be paid for that 2 week period i.e. 7 days pay. You effectively have a zero hours contract for the time you spend at the other site so no work, no pay.
  • 2 weeks compassionate leave for a close relative is extremely generous the norm I have worked with is a week for a direct relative.

    As there is no legal requirement for compassionate leave to be paid as pointed out 2 weeks is vastly more than most companies I'm afraid you're wrong to say it is uncompassionate.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    I'm sorry for your loss.
    |there is no general legal right to compassionate leave, either paid or unpaid, and unless your employer has a formal policy about it, it would usually be entirely at their discretion.

    2 weeks is fairly generous - a lot if aces would only offer a few days or a week, paid, although they might well offer additional time as unpaid leave if needed.

    Perhaps it would help you to think of it as if it were sick leave. You mentioned that your boss pays you at a higher rate for the second job because you don't get paid sick time - perhaps he saw the compassionate leave as similar.
