Employment Agency havent paid

My son worked for an Employment Agency on a Construction Site. The Site Manager signed the timesheet and sent it to the Agency. My son did receive a payslip from a payroll Company saying the money would be paid into his bank on 02/02/2018 but no money was received. A worker at the agency says he was told by the Construction Site Manager that my son and another lad were "kicked off the site for being caught smoking 3 times INDOORS". This is completely untrue as confirmed by the Construction Site Manager who signed his time sheet and sent it to the Agency. He was quite disgusted when I rang him and told him what had been said. He told me I should take legal action against the agency. I have found similar stories on Google Reviews about this agency. The agency staff are very rude and ridicule me when I ring and ask for my son to be paid. I believe this to be a small agency (maybe in one room) with the staff managed by one girl and a Managing Director. I have repeatedly asked for a copy of their Complaints Procedure but they say they do not have one and I should just email them my complaint. I have spoken to ACAS who were very interested and told me to ring /email the Employment Agency Standards Inspectorate (EAS) but their website has been archived and the phone number does not work. I have emailed BERR (Department for Business Enterprise & Regulatory Reform) but have heard nothing back. I am now at a loss as to what to do after going around in circles. Can anyone advise me please. Thank you

Sounds like your son needs to get something in writing from the construction manager to state that he was not caught smoking indoors which he can then pass to the agency - or get the construction to company to write to the agency directly...
Has your son actually written to the agency as instructed - or has the sole communication thus far been you ringing them?0 -

@ja7188 My son rang them for two days then I took over from Monday. I rang them and was told he would be paid that day, that he had missed the payroll, that he would be paid the next day, that the payroll company were at fault and various excuses. I started recording the calls and was being passed from person to person with them laughing. I had one girl shouting at me that she was very busy. I then asked for their complaints procedure and received an email saying I could email my complaint and they would look at it within 48 hours. I began to research the agency and found that they do this regularly. That's when I rang ACAS0

I use to work in payroll and if I had one of our employees mother asking my why and when her son would be paid I would refuse to help them. I would advise them that if they wanted the situation resolved then they would need to get their son to personally phone me and take the query from there. I would also cite the need for confidentiality as to why I couldn't answer a third party's question.0

Your son is a grown adult working on construction sites. I don’t see why he cannot sort out payroll issues himself.
I ask my parents for help and advice on all manner of things. I don’t make them ring up and do things for me, as indicated above, they probably can’t discuss the issues win you anyway0 -
My son has not made me do anything! The payroll company were really helpful! I feel it's best to forget I asked for help as most seem more interested in why I'm trying to help my son than the actual issue with him not being paid although he has been sent a payslip ! I will find help on another site with less malicious members!0

And that is where the problem lies! You have taken it upon yourself to phone and then wonder why you haven't got anywhere with it!0 -
I think that once he's got evidence from the Site Manager that the timesheet was correctly submitted and there were no other issues (like smoking) the best way forward would be Letter before Action and Small Claims court.
Does he have a copy of the signed timesheet himself, and if not will the site manager provide a copy?Signature removed for peace of mind0
