IPA signed but no payments asked for

Hi
I can't find any information anywhere. I have signed an IPA agreeing to an amount it's almost been 2 months and I have not been contacted by anyone for payment and I am 6 weeks from discharge. What happens if they don't ask for payments before discharge. Am I still bound by the terms

    An IPA has to be agreed before you are AD - if its not they can't come back for one. However, it sounds like your IPA has been agreed. Is it just a nil tax IPA or is it that plus a surplus income payment?

    It was an IPA due to surplus income. I've had the discussion and signed and returned the IPA forms back. But not had any money requested from me as of yet. Like I mentioned, I am discharged in 6 weeks

    The OR's IPA collection agency will be in touch eventually but in the meantime sit tight and wait. Keep the money for the IPA put to one side each month - don't spend it no matter how long it takes them to get round to asking for it. Did you get a date from when it would be paid?

    Hi there,

    I became bankrupt on the 1st of Feb, and had my interview on the 5th. There was mention of an IPA which I!!!8217;m not particularly keen about but them!!!8217;s the rules.

    I!!!8217;ve been looking around for information. As I understand it, these aren!!!8217;t set up straight away and have to be agreed unless you don!!!8217;t and it then becomes an IPO.

    Am I right in thinking that if an IPA hasn!!!8217;t been set up by the time the 12 months is up (1st Feb 2019) I don!!!8217;t need to make any payments at all?

    Also, what happens between now and the IPA? If, for example, it takes 3 months for it to be set up then do I have free cash to spend by that point?

    The figure mentioned was a bit high for my liking and having to pay it for 3 years doesn!!!8217;t appeal. I am totally on board with paying might I add, just that applying for bankruptcy was meant to be a clean slate for me.

    Sorry for being dim, just looking for clarification. Any hints and tips will be taken on board.

  • remember that an IPA is an agreement, if you dont agree with the amount then dont sign it, what you could do is post your SOA up on here, you may have forgotten to add things to it, silly things like car parking, stationary, vet bills etc. You may have also underestimated your living costs.

    Putting the correct figures down is not just about trying to avoid an IPA, its also about having a good standard of living, which by law you are entitled to have

    Thanks, it will need revising I think. I'm definitely not trying to avoid an IPA, I accept it's coming.

    So, do I just wait for the forms to arrive in the post and then challenge the IPA then? Or before?

    Also, what happens before the IPA is in place? For example, I get to the end of the month or next month, and nothing is in place. Do I get to keep what surplus income I would be using to pay, or not?
  • When you filled out the BR forms how much did you have left after expenses? For now i would personally put that amount to one side for the time being

    It!!!8217;s a long way back but I!!!8217;m fighting.

    We have been given an IPA and we have signed the paperwork but had no contact as yet from Clarke Willmott.....are we meant to save the money each month or do they just say your payments start on x date for 36 months? I know any nil tax has to be put aside separately thank you, been posting everywhere and googling but no answers aaargh
