Age and Gender Discrimination - Grievance Process

Hi all,

Will try to keep to the point and concise.
  • Been employed for almost 3 years. Had 2 promotions from Manager, to Senior to Director.
  • Always had issues with my salary and always told earning max possible.
  • Now Director from end October 2017, I complained at low salary but told it was due to 'years of experience' despite doing equal work of equal value to peers.
  • Last week, our boss showed the directors the salaries of all managers and senior managers.
  • I am earning less than those below me, and earning less than all of my peers (this I know through hear-say).
  • Peers are all female.

I plan to raise a grievance relating to equal pay, specifically raising my concern of the gender pay gap. I am going to state my concern linking to age discrimination and gender discrimination.

If we go through the grievance procedure, can I claim compensation and back pay? Or could they just increase salary from the date I raise the grievance?

I am also thinking of moving to a new organisation. One option is resigning and then raising a claim. However, would this look badly upon me if I haven't tried to remedy internally first?

    Do the others have more experience than you? You!!!8217;ve only been with the company a relatively short time.

    Where does age come into it? Where does gender come into it?

    If you don't raise this through the proper channels, you'll have no claim.

    Equal pay for work of equal value does not mean what you think it means.

    There is no reason why people doing the same job must be paid the same salary. You have allergy given one reason for why that might be - experience. Other reasons might include that you didn't negotiate as well as others, or that pay rates and market value have varied over time.

    It is only discrimination if the reason that you've been paid less is a result of age or gender, and not any other reason. Where is your evidence that that is the case?

    You may also wish to think about how a new organisation, where you have not got two years employment and job security, might consider your actions.

  • What sphere of business is it? just general, not specific.

    In your opinion. And if they have done the job for longer, there is your explanation for the differential.

    What evidence do you have to show that your gender and /or age are the reasons for the difference - not the years of experience others have, their ability to negotiate a better salary than you, or some other reason?

    Are you really a director of the company or is it just a title?

    It's a multinational company, there are many directors across all offices.

    And this is where your claim will tumble and fall.

    You are paid less because you are less experienced, not because you are younger and are male.

    End of story. You can think you’re gods gift as much as you want, and maybe you are, but that won’t hold water in your claim.
