The OP has says that they are intending to advise the friend to resign and claim constructive unfair dismissal at a tribunal before any disciplinary hearing even takes place. One must assume that that is a fact. On the basis that we assume that to be a fact, the advice they intend to give is extraordinarily bad advice. That is also a fact. Oh this is so true! I can think of a number of things colleagues get up to at my job that could, in practice, justify being disciplined for, including taking a few stationary items home, printing personal documents, spending a bit too long on the internet, all things that the bosses ignore mainly because all employees are pretty indispensable, and although not irreplaceable, the process of doing so and risk associated with it is worth some flexibility. I'm sure it would become a different matter if the staff was to suddenly cause trouble that would cause the company that they would be better off replaced.Few of us could pass the test of being so perfect that our employer couldn't find something to hang us for if they wanted to. Most of the time that is something the employer cannot be arsed doing - more trouble than it is worth.0
