Holiday Entitlement

Hi,

This is my first full year working part time. Last year I came back to work midway through the year after being on maternity for 1 year. I worked full time previously. I now work every Monday-Wednesday, 21 hours a week. As a full time worker I was entitled to 28 days holiday plus 6 bank holidays (Easter, Xmas and New Year).

I've worked out that as a part timer I should be entitled to the minimum of 16.8 days holiday but my work are saying 16, can they round it down?

Also in regards to bank holidays which I got as a full timer, if they fall on my days off (Easter Friday always will) am I no longer entitled to these days as I don't work them?

I'd like to be armed with some knowledge before I approach HR.

    Are your work saying 16 days or 16 days plus bank holidays? They can't round down if they're only offering statutory.

    This year they are saying 16 days statutory holidays and are giving me 5 bank holidays on top of these 16 days (1 at Easter, 2 at Christmas and 2 at New Year).

    My full time colleagues get 28 days statutory with 6 bank holidays on top.

    You are entitled to 3/5 of 34=20.4 total.

    You get 21 which is more.

    I just need to find out what happens in a year Xmas/New Year falls on a Thursday Friday as I'll only get 1 bank holiday then but I've got a couple years to worry about that!

    You'll have to keep one of your 'normal' days to take instead of the bank holiday.

    You get the same proportion of holiday as your f/t colleagues, but there are some years when you will have less choice about when to take some of the days.

    From the way you describe it the Bank holidays are included in your holiday allowance calculation and so if they fall on a day you would normally work you will have to use a day's holiday to take it off - if they don;t you won;t have to use any holiday.
