How much were you overpaid and how long have they said they would take it back over?
A colleague I work with was overpaid several hundred pounds and our employer agreed to recover it over 8 months. She evidences the overpayment had reduced her overdraft and the bank had then cut the available overdraft limit. Therefore to repay quickly was going to leave her in financial difficulties. She was embarrassed to explain this to payroll and management but she couldn't afford to just repay it. In fairness she hadn't just spent the money. The main stipulation from work was that it had to be repaid within the tax year, i.e. before end of March.DFW Nerd No. 1484 LBM 07/01/15 Debt was £95k  Now debt free and happy :j0 -
Hi ajnsd1888 and welcome to MSE,
The repayment is something you will need to negotiate with your employer. If you cannot afford what they have suggest, you could do a SOA and ask them to consider smaller repayments, especially if it was their error. If they are unhappy they could pass the matter to debt collectors or take county court action, but the bigger issue would be check it would affect your employment or any promotional opportunities.
Please be aware that debt collectors are not a bailiff, so have no right of entry or repossession. And county court is mainly done in the post so you are unlikely to have to go to court. Also this shouldn't be on your credit file unless a CCJ is obtained. Best of luck,
Laura

Why did you spend the money when you clearly realised you had been overpaid (you told them, after all)?....LBM July 2006. Debt free 01 Sept 12 .. :T

We went through this where I work a couple of years back. Everyone in October I think it was who did overtime at weekends got double what they should have done. Wasn't such a bother for me as I hadn't done that much that month, but some people were paid considerable sums of money extra. We figured something was wrong as everyone was gasping at their pay packet that month, so someone contacted payroll. The wise amongst us then didn't spend that money as it was going to be taken in full from next months pay packet.
My experience of it was there were no monthly repayment options offered. Nobody that I am aware of however got to the debt collection phase, we just paid it back. I'm afraid to say that I think they will be quite aggressive in their chasing of this. They may just take the whole lot back out of your pay next month, or perhaps they are giving you some leeway if you are lucky? I wouldn't be expecting this to all just blow over if this is what you are hoping for...
I now religiously check my payslip every month for miscalculations - not much help to you now, but a lesson perhaps.0 -
ALWAYS check your pay - have an idea of what you expect to receive if it's variable, and if it's more when it turns up than you thought it should be, for goodness sake never dip into it until you have in black & white from your employer that the amount they paid you was, as far as they are concerned, correct. The situation January2015 mentions where it affects an overdraft limit is unusual - and clearly if the bank acted fast, may have proved tricky, but I get the feeling that this is NOT the OP's situation.🎉 MORTGAGE FREE (First time!) 30/09/2016 🎉 And now we go again…New mortgage taken 01/09/23 🏡
