Non-supply of contract or T&C's

I took out my mortgage in 2000, they sent me a welcome pack but no copy of contract or T&Cs. It was my first mortgage and naively I didn't notice at the time.
In 2011 I had reason to ask for both, they sent me an offer letter. I asked again, they refused. I repeated this process in 2013, still no joy.
I have reason to believe I have been vastly overcharged interest. None of the documents I have include the relevant information.
I keep asking, they keep sending the wrong documents!!
I suspect a cover-up of foul play.
Any ideas what I can do?

What bank or building society?
Have you not remortgaged in all that time? 18 years is a long time to have your mortgage with one provider.
Why do you believe you have been overcharged?0 -
Bank of Scotland (Halifax)
No, never remortgaged.
I believe I have been overcharged because they failed to drop the interest rate sufficiently after the "crash". Indeed they even put the rate up! The rate when I took it out was 1.35% over base, now it is 4.45% over. Something is very wrong.
My original offer didn't specify the name of the product or the interest rate or % over base.
They seem to be making things up as they go along.
I can't understand why they refuse to send me a copy of my contract and the T&C booklet, which was referenced but never actually provided.
They have something to hide!
Thanks for reply, any help or ideas welcome.0 -
Did you fall into arrears at any point?
Change the term?
Take additional borrowing?
It sounds as though you are on the current mortgage rate for new customers.
What do your mortgage statements say? Have you kept records of these?0 -
-
Yes, arrears for a while, due to redundancy, but everything was paid back, (plus enormous costs) and I have been paying as normal ever since.
Also a little additional borrowing, but this was allowed as a facility as a feature of the "Personal Choice" mortgage.
I have some of the statements, most of them probably.
The statements don't mention any interest rate charged either!Or reason for any change.
I wrote to them this week asking them to look into this and today I received a redemption statement!!!!! The figures on which are different to my Annual Statement which arrived on the same day. Still no answer to any of my queries or requests It's like dealing with aliens.0 -
Do you work for Bank of Scotland by any chance?0

What is a subject data access request? Do I write to Bank of Scotland and simply request it?
Thanks for trying to help!0 -
Ha Ha!! A typical response from someone who has no answers! Just unhelpful, patronizing, sarky comments in reply to a tongue-in-cheek comment made in fun.
Don,t reply to me again!
I was going to contribute and had partly started a response until I saw the way you were answering. However, you can consider me out of this thread. And seeing how you appear to be lacking responses from any of the other regular posters in this section, it looks like they are silently doing the same.I am an Independent Financial Adviser (IFA).
