Today I received a NTRK letter from MET Parking Services re a parking charge at Southgate park, Stansted (aka Starbucks/McDonalds/BP services) which took place on Dec17th
It states the reason for issuing the charge notice is: Left the premises (SPC)
On its website it has 10 camera pictures of a car parking in the Starbucks car park at 1300hrs and leaving at 1340hrs (so well within the 60min max allowed) It also showed a 'person' exiting the car and walking to the neighbouring mcdonalds (a mere 60ft away)
I wish to contest the charge,
I have read the newbies sticky Thread and think I understand the process.
As I understand it I need to appeal and get a POPLA reference and then send a longer appeal once I have received it.
The newbie advice is to appeal via the website where poss, and not to reveal the driver. However, the MET appeal website has dropdown boxes which require you to state DRIVER or KEEPER etc
How do folks get around this requirement?
And if someone is able to advise how to get around submitting the info they state i must submit, do I just cut and paste the standard wording as below?:
Re PCN number:
I am the keeper of the vehicle which received this purported 'parking charge'. There will be no admissions as to who was driving and no assumptions can be drawn. I am not liable and I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs are in small print and the onerous terms are not readable.
Should you fail to cancel this PCN immediately, I require the following information with your template rejection:
1. Does your charge represent damages for breach of contract? Answer yes or no.
2. Please provide dated photos of the signs that you say were on site, which you contend formed a contract.
3. Please provide all photographs taken of this vehicle.
I am alarmed by your contact and I do not give you consent to process any data relating to me, or this vehicle. I deny liability and will not respond to debt collectors. You must consider this letter a Section 10 Notice under the DPA, and should you fail to respond accordingly, your company will be reported to the Information Commissioner.
I have kept proof of submission of this appeal and will also be making a formal complaint to your client landowner.
If you are a current BPA member, send me a POPLA code. If you are an IPC firm, cease and desist with all contact.
Thanks for advice. I want to make sure I am doing the right thing before sending the initial appeal....:o

`Save a little money each month, and at the end of the year, you'll be suprised at how little you have.

Appeal as keeper
Yes use that template appeal! The FAQ is bang up to date and no need to check each step on the journey!0 -
The PPC is required to mitigate their losses. Therefore, if the Parking Weasel was aware that you were about to commit a breach of contract he/she should have warned you of the likely cost if your actions.
These cases rarely if ever get to court as the PPC is unlikely to have taken sufficient steps to mitigate their losses. You never know how far you can go until you go too far.0 -
Thanks for the replies.
Does the fact that the event was on Dec 17th (ie 27 working days ago) have any bearing on the charge? And I received no notice at the time, ie windscreen notice.`Save a little money each month, and at the end of the year, you'll be suprised at how little you have.

NO , because you are appealing as KEEPER (not as DRIVER) as if the notice was handed to you as keeper
so a keeper appeal with the template is all you need to do , choosing KEEPER from any boxes
but you only have 28 days to appeal a postal notice so better be sharp about it0 -
Number of working days are irrelevant.
As advised by Redx, appeal a NTK straight away, unless it is a bylaws case.
Don't miss the appeal deadline.I married my cousin. I had to...I don't have a sister.
All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
bear in mind that the 28 DAYS is CALENDAR DAYS , not WORKING DAYS , SO IN THEORY ITS TOO LATE TO APPEAL, but do it anyway
ie:- 17th dec to 25 jan is about 41 days , so you missed the boat0 -
Crikey. But I only received the notice today!!!
The letter was dated 22nd jan 2018`Save a little money each month, and at the end of the year, you'll be suprised at how little you have.

in that case they failed POFA2012 if there was no windscreen ticket
but they may have ghost ticketed the car, removing it afterwards
in any case, as the postal notice was received TODAY , you have 28 days to appeal as keeper , so do so as described above0 -
Did the NTK offer a discount for early payment?hubblebubble wrote: »Crikey. But I only received the notice today!!!

So appeal it, as per the NEWBIES thread. The sticky thread covers it.hubblebubble wrote: »Crikey. But I only received the notice today!!!

At this stage there is absolutely no need for a new thread, in fact the NEWBIES thread asks not to, as we need to concentrate on a stage where people DO need advice (e.g. POPLA stage). That will be you later on and you'll no doubt hope that not many 'first appeal stage' threads are distracting us. This is the truth, you will see later, when you do need help.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
